Mental state, illness, lack of understanding and external influences can be factors that influence the capacity of an individual to express consent.

An assessment is carried out on the suitability to give consent for activities or actions and only those deemed able and safe to are given permission to consent.

If consent cannot be readily established then he next of kin would be contacted or power of attorney would be sought and the situation would be explained.
