The Legal Issues of Copyrights
Copyright protects anything that would fall under the label of creative expression and a good Web designer needs to be aware of these laws so they are not held liable (Copyright 1995-2011). The images and articles in a company’s advertisements and web site are protected under copyright law and the copyright takes effect as soon as the image or article is made or the finished edited version is saved on a computer (Copyright 1995-2011). There are a few things a copyright does not protect such as names; which are trademarks, or ideas; they are protected under patents (Copyright 1995-2011). The copyright laws for Web use like an advertisement banner image or the text to describe a company or item a company sells is all protected under copyright. Web designers need to be sure that the images and text are their own work or the copyright is owned by the company they work for. Any company or person using an image, article, or creative expression that is not owned by the Web designer or the company they work for can be held liable for breaking the copyright law (Legal Pitfalls 2006).
Copyright infringement from the Internet can be anything as simple as clicking on an image and right clicking on save as, and downloading the image on your computer and using it on the web. Another example is to copy an article someone has written and putting it in your website, blog, or forum. You may use images that someone else created if you get the owner’s permission to use the image. You also can use copyright free images from an image stock company but lots of research into using a copyright free image has to be done to insure it is copyright free. There are also stock image companies who charge companies and individuals a fee for the right to use an image. There is also a fair use clause in copyright laws; if there is a quote from a different author I want to discuss, I can

A Copyright it the sole privilege of the owner to duplicate or allow someone else to duplicate their work. Items that can be copyrighted are anything that one creates including but not limited to literary work such as articles, stories and even computer programs. Along with any graphics, pictures, music, song lyrics, screenplays and movies can also be copyrighted by their owner or creator. If there is a question if something is copyrighted it more than likely is copyrighted and you will need permission to use it if not that is considered copyright infringement which is wrong and punishable by law. Something as simple as printing a Web page, downloading a picture, printing and image even copy the HTML, JavaScript is considered infringement and against the law. If you chose to copy code from a Web site you must show the original author respect by properly citing the material and following necessary steps. You do so by asking for permission to use their material. To use text or an image from a Web site you just need to contact the owner and explain what you would like to use the text or image for and then ask to use it. No matter if an image or text does not have a copyright notice or not it is still covered by the copyright laws, (J Kyrnin 2012)…

The lines between personal property and public domain are becoming increasingly blurred as more people become connected by the internet. In her article, the main point Rachel Kadish makes is that, "If your face isn't private property, what is?" (Kadish 262). She is referring to the self portrait of her cousin, Noam Galai. After he uploaded the picture to his Flickr account, it was then downloaded by tons of people, who represented the work in ways he hadn't intended. Some even sold T shirts and prints of the picture for their own personal profit. Theft of digital property is nothing new on the internet, and for some reason, stealing data doesn't really feel like stealing. Ever since the invention of the internet, people have been downloading illegal copies of games and programs. The point is, it's very hard for anyone, even corporations, to maintain control of the distribution of their data.…

In this article of “Kill the Internet- and Other Anti-SOPA Myths”, the author Goldberg indicates that basically anything that was posted on the internet was at risk with the anti-piracy. This is just technically stating that everything that is posted on the internet has the ability to be plagiarized or abuse the copyright act. As well as Google’s ability to be making money off of everything that is being posted onto their website ( “Google alone generated more than $37 billion in 2011, more than double the revenue of all record companies, major and indie combined” ).…

Without informing anyone Ralph decided to use that same code with his current company. At first his manager was enthusiastic about the new code until it was brought to light that it was copyrighted. In Ralph’s ethical mind he did nothing wrong because he created the code. The legal aspect with this is that in the past when Ralph was working for another company it was copyrighted, so they have the rights even though Ralph created the code. Anything Ralph created while working at the previous company belongs to that company.…

Copyright for graphic designersCopyright is the legal exclusive right of the author of a creative work to control the copying of the work or the making of works derived from the original. Some examples of creative works are visual works like illustrations, photographs, and graphic designs, written works like books, articles, music and plays, recorded works like music and movies, etc. Here is a link to more information than you'd ever need about copyright: http://www.answers.com/copyright&r=67The copyright owner, and only the copyright owner, controls the right to: • reproduce the work in copies • prepare derivative works based upon the work • distribute copies of the work by sale, rental, lease or lending • display or perform the work publiclyThe work must be in tangible form, i.e., written or recorded. Ideas or unrecorded speech (like something you say) is not copyrighted.Every creative work is automatically copyrighted the moment it is fixed in tangible form. There is no need to register it. The copyright symbol, year and person owning it may be put on the work, but it doesn't have to be to be protected. The copyright owner owns the copyright for his/her lifetime, and then his estate owns it for 70 years after his death. Generally speaking, works created more than 75 years ago and works created by the government are in the public domain.Scanning and using someone else's images in your work without permission is derivative, and is a copyright infringement in the following ways: • First, the act of scanning it violates the person's exclusive right to copy it. • Second, the act of putting it in your work violates the person's exclusive right to make works derived from the original. • Third, each time your derivative piece is printed or displayed, the person's exclusive right to distribute the work is violated.Just because artwork or photos are on the internet and easy to copy, doesn't mean you can copy and use them without permission.Moral of the story: • If you want…

Copyright law applies to all information that is available to view and be stored. It applies to music downloads, personal details, medical history, financial records, and protects a company or creator from plagiarism and theft of owned ideas and work. When referencing someone else’s work it is important to acknowledging sources such as websites or books used. This also applies to images taken from imaging sites unless bought through stock photography. Electronically, access to information can be restricted and permissions granted to only those chosen by the authority, an example of this is an HR folder in a company network. Only authorised members of the HR department would have access to the folder and its contents as it would contain personal and confidential information. A person or a business proven to be breaking the Data Protection Act and Copyright laws will be heavily fined and can face a prison sentence.…
