Copyright Concerns

Summary of Facts
Ralph, a software engineer for SDX Alliance had the task of writing a computer code. In the past he had already worked on something similar as an intern at another company. Without informing anyone Ralph decided to use that same code with his current company. At first his manager was enthusiastic about the new code until it was brought to light that it was copyrighted. In Ralph’s ethical mind he did nothing wrong because he created the code. The legal aspect with this is that in the past when Ralph was working for another company it was copyrighted, so they have the rights even though Ralph created the code. Anything Ralph created while working at the previous company belongs to that company.
Consequences. Even though Ralph did not realize he did anything wrong it does not excuse him from any copyright laws. Ralph may be a good person

With the use of moral imagination there are alternatives to prevent a situation like this occurring. Moral imagination is defined as “one element that distinguishes good people who make ethically responsible decisions from people who do not” (Hartman, DesJardins, & MacDonald, 2014, p. 55). Ralph had good intentions but did not make an ethically responsible decision. To correct the problem Ralph could use all resources necessary to connect with the previous company to ask for permission, which would be the best and quickest alternative if he was successful and granted permission. Another alternative which could cost valuable time, is that Ralph already having the basic knowledge to create the code, he can create something similar without infringing on any copyright laws. Lastly the alternative that is not the most ethical and possibly most risky is that they can go ahead with the code and hope that nobody notices since the company is out of

    Ralph, a round character introduced in Lord of the Flies, seems to be the most likable and civilized boy on the island.     1. Intellectual Property refers to a number of creations of the mind for which exclusive rights are recognized. This includes inventions, literature, art, symbols, and designs used by a business. With the ease of stealing from the web, copyright laws and intellectual property are important things to consider when creating a web page. Two intellectual property issues that I foresee are the copying or downloading of Ellen’s illustrations and games. Although users should ask before using images or software from a website, it does not always prevent infringement. Since Ellen plans to use her own copyrighted illustrations from her books on the website, she will not infringe others’ intellectual property but will need to consider how to keep her own property from being stolen. Ellen’s idea of having users’ register is a great tool to protect her copyrighted property. This ensures the user must accept and agree to the Terms of Service and can be charged later for improper use and distribution. Ellen should include a Terms of Service agreement, which clearly displays the license terms to the user and which requires the user to actively indicate acceptance of the terms by clicking on "Yes" or "I accept" before the software can be downloaded. Otherwise, there is a risk that the user could get out of being held the terms. Another step to consider is having a part of the website with a paid membership to download screensavers and games. She may also want to take into account the option of converting some of the more popular games to a mobile platform for downloading to receive royalties from mobile device users such as the Nick Jr site displays a link to iPhone apps. Intellectual property rights are a business asset, and are often the most valuable business asset. Any business considering trading on the internet needs to check what intellectual property rights it owns and ensure that it is fully protected.…

    This case presents a very typical situation that people encounter while working in the corporate environment. What is ethical, what is morally correct and what is just right out against the law are the questions that we all face while working in a corporate environment. Some of the ethical questions are governed by the law facing the situation. For example while working in an investment bank you most probably have access to inside information about upcoming deals that one could possibly use for personal monetary gain or you could act as a tippie and possibly share that confidential information with others. This kind of a situation is definilety governed by the law and you can actually be charged with various insider trading laws and possibly do some jail time as well. The other situation that is presented in the case is purely about ones ethical and moral standards. The analyst either has to compromise her loyalty towards her company B&B or towards her best friend Lori. While the situation presented is not a real zero-sum game, i.e., one player’s loss does not equal to the gain of the other player. When faced in a situation like this one has to think about what decisions can be made that will have the least affect on the players involved. The analyst should not look at the situation she faces as black or white. She should rather think about other options she might have to retain her friend’s loyalty while not compromising her loyalty towards her current employer. For example, Lori has already been laid off by her current employer, Universal group. The Universal group has already broken certain ethical and moral laws by not informing about the situation to B&B. So can the analyst come up with a situation where she can get Lori immediately and legally hired at B&B and convince her to share the information with B&B.
