Richard Fenno's work, Congress at the Grassroots, provides an in depth look at the decline of the old time politics of the South in the late twentieth century. Fenno's case study examines a more recent era but confronts some of the same problems faced by the fictional governor. With changing times and technologies, how do the politics and politicians of the past fare with the modern era? In an effort to examine the recent political shifts in the Deep South and its Congressional districts, the author selected a noteworthy area--the district held by former House Speaker Newt Gingrich. Instead of selecting the controversial Gingrich as an illustration of change, Fenno chose a long-time Democratic predecessor and the Republican heir to the Georgia district. The area south of Atlanta, for generations a rural, conservative Democratic area, quickly changed to a suburban, Republican-dominated one from the 1950s to the 1990s. Fenno's goal was to provide an in depth look at this dramatic change that impacted the South and the entire nation. He also sought to examine these relationships as a cause in the increasing "polarization, along party lines" of the House of Representatives which made Congress "less civil, less manageable, and, to many, a less satisfying process" (p. 151).…

This is not a story of good versus evil. Nor is it a tale of right versus wrong. The decision of the morality and constitutionality of the new healthcare law is for someone else to make. This paper simply seeks to address Congress’ role in the long and confusing process of passing healthcare reform. As a group, we attempted to consider every major policy actor in the healthcare reform process. We identified seven major actors: the Obama administration, Congress, the congressional budget office (CBO), advocacy groups, the insurance industry, public opinion, and the legal challenges of the law. While each actor played a specific role in the policy-making process, the bills were ultimately produced and passed by the two bodies of Congress. When the wording of a statute is not clear and explicit, then it is difficult to know how a particular statute should be applied. Supreme Court Justice Scalia wrongly clams that legislative history should not be used when interpreting an ambiguous statute’s meaning. He is wrong to state that it is undemocratic to use legislative history because legislators, staffers, and lobbyists are all a part of the process of the creation of statutes. Legislators often intentionally write a statute ambiguously, so that a compromise can be reached. Therefore, judges should use the floor reports, presidential messages and committee reports when trying to interpret ambiguous statues. Additionally, Scalia states that those who are in favor of legislative history are trying to make legislative history the law. Legislative history is merely a tool to be used when interpreting ambiguous statutes. Scalia himself utilizes legislative history when dealing with ambiguous statutes as seen in Pierce V. Underwood and Green V. Bock. Ultimately, legislative history adds a great deal of value to judicial interpretation, so not using it, as Scalia suggests, would be a mistake.…
