Let's Put Pornography Back In The Closet Analysis
In her essay, ‘Let’s Put Pornography Back in the Closet,’ Susan Brownmiller expresses her discontent with the First Amendment in that she opines it has been wrongly applied therefore leading to its failure to abate pornography. In contrast she views that the First Amendment has been used to proliferate pornography and pornographic material in a number of ways that she outlines in her essay.
Brownmiller comments on the abuse of the First Amendment by giving controversial legal instances like James Joyce’s literature work known as Ulysses. According to Brownmiller’s perspective, the application of the First Amendment in Ulysses and later on Henry Mill’s books set the precedent of such pornographic literature work being passed on as non-obscene.

This is viewed as too broad and vague by the Free Speech Coalition. Under Miller v. California pornography can only be banned if it is considered obscene and without redeeming social value or rather if it would offend the average person. The problem with the CPPA was that even film and art, for example ideas produced centuries ago would be considered a violation. According to the First Amendment there is a difference between actions and words; although, certain categories of speech are protected especially those concerning children, those protected categories were not included in the CPPA. The speech used in the CPPA was not remarkable enough to persuade others to break the law; therefore, it cannot be banned. Because the language used was much too vague it was ruled that the prohibitions of the CPPA were overboard and…

The first amendment guarantees the right of free expression to all citizens of the United States. Leonard Pitt’s writing “Who decides if it’s art or porn?” brings up a major issue with the first amendment of free expression. Pitts states his thesis towards the end of his article with the two questions, “What is the line where obscenity ends and art begins? And who gets to say?” I’m not entirely sure about the answer to the first question, but I do know that the government and the judges of the court have the power to decide what the difference is.…

Even though there was a lot of controversy encompassing the Flynt case, from extreme right-wingers to the general public, the U.S. Supreme Courts ruled that Larry Flynt had the right to freedom of speech through the medium of his magazine. Radical feminist, Catherine MacKinnon went as far to say that it was the libertarians fault, placing the needs of freedom of speech over woman’s well-being. She argued that pornography encroached on women’s freedom and that pornography had nothing to do with freedom of speech. To those that are on a more neutral ground with the subject, when asked if woman are subordinated or harmed in some way do to pornography, and if men are sexually violent, those neutral parties would most likely say no. Many people look and read magazines like Hustler and Playboy for entertainment value. Some may even say that they have learned a great deal about sex by reading them, often because their own parents were too embarrassed to talk to them about sex at a younger age.…

First, society has an interest in protecting kids (especially those in the audience) from lewd , vulgar , and sexually explicit speech. Also, schools have a duty to teach student speakers the “habits and manners of civility” essential to democratic governance. Schools must teach students to responsibly consider the sensibilities of others, even when exercising their right to express unpopular viewpoints. Schools may reasonably conclude the boundaries of socially appropriate behavior cannot adequately be taught to students in an environment where the right to communicate in lewd, vulgar, and sexually explicit terms are absolute. Therefore, schools can constitutionally punish students for vulgar and lewd speech inconsistent with their educational…

It is my feelings that pornography should be censored and no it does not violate the First Amendment. I am not as well versed on the Constitution of the United States as I would like to be, but I do know that the First Amendment is intended to allow freedom of religion, the right to exercise that religion; freedom of speech, individual or the press; freedom to peaceably assemble; and the freedom to petition the Government for any grievances. I also realize that amendments are subject to interpretation, and some court rulings of the years have altered the actual interpretation of this amendment. The intended purpose was to protect individuals and groups from persecution for practicing their beliefs. Society as a whole has put limitations on…

America’s War on Sex is based upon the central point to which everyone who is a citizen in America, has the right to entitle their own opinion. Part of being free is entitling your opinion and having a say on your rights as a citizen. This book defines and looks at the many violations of civil liberties in reference to sexual freedom. You will find policies that could create social problems and increase personal anxiety. In America’s War on Sex by Dr. Marty Klein there is a group of people who are using political power to convert scientific evidence with religious moral values as the basis of law. Private sexual choices that should be made by one-self are now being limited with tax money, by slowly taking out adult entertainment based upon moral values. It is now said to be that a woman’s right to make her own decisions is now more influenced by religious views than by herself and her doctor. Among the central point there are other factors, such as being open about sex as to being “in the closet” about sex, abortion and contraception and its controversy, and much more. This book opens up and gets a broader perspective and understanding on sexual expression, exploration, health, choice, entertainment, and pleasure.…

Finally, the last exception to the freedom of expression, involving what one says and publishes is obscenity. Obscenity is “acts or statements that are extremely offensive under current societal standards” (pages 124-125). According to the textbook, the Supreme Court, in 1973, established the Miller test, which helped decide whether or not something was truly obscene (page 125). With the creation of this test, it made it possible, even though it is sometimes tricky, to decide whether or not something is obscene and not protected by the freedom of…

When discussing the “XXX” industry, otherwise known as pornography or the adult film industry, people tend to discuss it in hushed tones, or rather not discuss it much at all. When it comes to sex in general, America generally is uncomfortable talking about sex and topics related to it. It should come as no surprise that the porn industry is treated in a similar fashion. Pornography, according to Sullivan, was considered “sexually 'explicit' writings, still or motion pictures and similar products designed to be sexually arousing,” (Sullivan, 2012, pg.321).…

The first amendment protects the freedom of speech. This case of Reno v American Civil Liberties Union represents an interesting debate on protection of freedom of speech versus regulation of material which is regarded indecent. The subject matter in this case was the Communication Decency Act against Internet on the issue of indecency. The case compared Internet with Library, Television and Public Place. However, in comparing with these mediums, Internet appears to be slightly, if not majorly, different. It is because, when compared with the television, the internet user might have to go…

Although the first amendment was written into our constitution, the translation of the meaning of the written word is often challenged. Some people believe freedom of speech should not include hate words, pornography, and vulgar language in our music or on the radio or public television. In addition, there are people who believe in freedom of religion but only if the faith is similar to their own and there is a constant debate regarding freedom of the press and what newspapers should be able to report. Because interpretation of the first amendment is sometimes challenged, some court rulings on important cases regarding freedom of speech, religion, and press have changed some perceptions.…

The first essay argues that the risk and threat from child pornography, and should not protect such speech. The second one argues about privacy and free speech from this issue. The only maximum disagreement that Dalton's private journal is protected or not by the First Amendment. First of all, issue about child pornography in the law. According to PROTECT Act of 2003, “Laws on child pornography are very strict with the harshest penalties in the world and often censored, but fictional child nudity and erotica is protected as freedom of expression if considered art, unless it is considered obscene” (Newitz, Annalee). U.S. federal government considers real child pornography is illegal, Fictional child pornography (unless Obscene) of possession, sale, production, and distribution are allowed protected, but above situations only apply to fictional things. Dalton’s case has conflicted with the key word “obscene” although it is fictional thing, and he shared it with a couple of people, it would be serious trouble. The first essay is stronger than second one at this point. Secondly, this issue with free speech and privacy. The free speech as one foremost and fundamental rights in United States. In liberal view, you can choose like it or not, but you don’t have to look at it either. For example, if there is a student’s speech can be ban because of its threat to other students, such case is not free speech. In fact, it is extremely difficult to decide what speech should be protecting and what speech should be limited to protect children. However, according to fundamental principle, real liberty that is one's freedom does not destroy the freedom of others. Unfortunately, most of people don’t deeply understand about that, they always use their moral values to kidnap freedom of others. Be that as it may, when is it suitable to limit speech? Whether the circumstance includes obscenity. It…
