The reason of why I want to enter into this type of an agreement with Marietta, mainly because of my past experience has left me uneasy. Not only has the financial been traumatic, but the fight for equal custody was strenuous. After few years of counseling, I regained my dignity and again started my life. Now I do not want the same incident to repeat once again and by chance my second relationships with Marietta doesn’t go well. Then, I want to handle it more maturely without letting my morals get hurt and that the reason of why the agreement is needed for me.

My biggest fear is that my past could repeat and I do not want to suffer in the same manner like I did four years back. The biggest pain would be losing the custody of my child that Marietta could take my child and move to Philippines. In which, she feel that the child would be better off living near her "close-knit family" where they would give more love and affection. In my pre-nuptial agreement, I want to include all the clauses which will give me equal rights on my child and the benefits. Also, other fear I had from my previous divorce that I would lose a lot of my hard earned money and to overcome that fear. I prefer to have a pre-nuptial agreement as my defense and protection of my financially.

A pre-nuptial agreement gives the rights to have finances separate that every state has laws appoint certain kinds of resources gather during marriage as marital property or community property (Nolo – What the Laws Allows). Such as, if there was occur that Marietta and I get a divorce or I was to die. Then, our marital or community property will be divided, either by agreement or by a court (Nolo – What the Laws Allows). Other law of the agreement is providing for children from prior marriages and this is helpful. Since, I have one child from previous marriage that I have the right to claim my child to inherit the share of my property (Nolo – What the Laws Allows).

Further proceedings would ensue regarding attorneys’ fees. This determination was based on the interpretation of the verbiage of the Decree in compliance with Arizona state law. Even the intentional omission of language regarding the termination of spousal maintenance upon the remarriage of the spouse in receipt of the maintenance does not serve as an “express” statement that the parties intended the spousal maintenance to continue after remarriage. Interpreting the lack of reference to termination upon remarriage in this situation requires a level of inference that does not fulfill the legal specification for an express statement. The court holds that if spouses seek to avoid the application of the Arizona state law regarding spousal maintenance termination upon remarriage, the intention to do so must be made unmistakably clear. Due to the fact that the decree does not expressly state that the spousal maintenance should continue after the remarriage of the wife, the court concludes that the obligation to pay is terminated upon the wife’s…

FACTS: The parties were married on March 1, 1959. Plaintiff had a 15 year old daughter by a previous marriage. It was planned that she would live with them, as well as agreed upon that after marriage the defendant’s mother from Hungary would be moved in with them (September 11, 1964). Defendant testified that he would not have married plaintiff if his mother could not live with them. Within a very short time after the arrival of the mother-in-law, the incompatibility between her and the plaintiff caused a disintegration of the marriage. After a psychologist and counselor were called upon, the plaintiff gave the defendant an ultimatum of living with her or his mother and the defendant chose his mother. Plaintiff moved out with daughters on July 9, 1965. Both plaintiff and defendant said they would take the other back upon submission of the other’s stance. Plaintiff sued her husband for maintenance and support for herself and the infant child of their marriage. The Chancery Division entered judgment for defendant. Plaintiff appealed.…

In light of holdings and propositions coming out of Chapman v. Chapman, (1987) 191 Cal. App.3d 1308, 237 Cal.Rptr.84 and Bukaty v. Bukaty, (1986) 180 Cal.App.3d 143, 225 Cal.Rptr. 492, it is likely that a court may consider, among other things, our clients initial marriage and timeframe between the second marriage in determining the spousal support award. However, it is unlikely that the court will consider the duration of our client’s cohabitation with her current spouse as the Family Law Act does not apply to non-marital relationships. Bukaty suggests that for these years, a Marvin type action would need to be filed in civil court to seek a…

In the case of Kostres and Kostres [2009] FamCAFC, the parties had executed a pre-nuptial agreement with the intention to mutually share the assets obtained during marriage in the event of a divorce. Mrs Kostres sought to uphold the terms of the agreement but dispute arose regarding the interpretation of the agreement. On appeal by the husband, the Full Court nullified the financial agreement due to the difficulty in determining the intentions of the parties. Although financial agreements are aimed at achieving justice for parties, this case indicates that interests of parties become conflicting as the relationship breaks down, hence undermining the original…

My divorce, after 5 years of marriage, had been finalized a year before I started dating Marietta. Although I am now financially stable, after hard work, sweat and tears, the divorce process and custody battle has been extremely stressful and has put me in a traumatic state financially, that I no longer wish to experience again. This is the reason why I want to put a pre-nuptial agreement together when I remarry to Marietta. My decision has nothing to do with her personally. I just feel that anything is possible, which is obviously why I am divorced, and because we all are liable to make mistakes.…

This Act is intended to be relatively limited in scope. Section 1 defines a "premarital agreement" as "and agreement between prospective spouses made in contemplation of marriage and to be effective upon marriage.” Section 2 requires that a premarital agreement be in writing and signed by both parties. Section 4 provides that a premarital agreement becomes effective upon the marriage of the parties. These sections establish significant parameters. That is, the Act does not deal with agreements between persons who live together but who do not contemplate marriage or who do not marry. Nor does the Act provide for postnuptial or separation agreements or with oral agreements. At this time Florida has not adopted the act. Florida Statute 741.0306f.s.…

Marriage is always automatically related to the possibility of annulment, but with the creation of covenant marriage its main purpose is strengthen the institution of marriage by making it much harder for couples to obtain a divorce. (Spaht, p.74, 1998). Research by Spaht clarifies that by preserving a marriage it not only benefits the two spouses, but also the children involved. Legislation laws have also been enforced for couples that choose a covenant marriage which include: mandatory pre-martial counseling, a legal binding agreement, and terminating the divorce based upon misconduct by a spouse (Spaht, p.75, 1998). By devoting a serious effort these three mechanisms have established a solid foundation for the overall purpose of preserving a covenant marriage.…
