1. Define the term “collective bargaining” and list and describe four issues that are mandatory components of a collective bargaining agreement. Collective bargaining is the process of negotiations involving the representatives of the employer and employee for terms and conditions of employment that will apply to the employee. In the United States the negotiations that happen between concerning parties are written into legally binding contracts and usually last from one to five years (Budd, 2013). There were over 30 allegations of unfair labor practices filed with the NLRB accusing the chain of trying to silence protesting workers. In addition, the complaints claim that the company retaliated against, disciplined, intimidated, surveilled and sometimes terminated employees in six states, including California, after the workers voiced opposition to various Wal-Mart activities (Hsu, 2013). Both parties came to a tentative agreement, however, this was temporary. Because each could not come to a mutual agreement, negotiations then went to a binding arbitration in which they both had to submit their best and final offers. As a result, the IAFF was awarded their offer and was able to maintain the fourth shift. This included additional 85 to 100 fire fighters that the county was being force to hire in order to eliminate overtime.
