Not only does being prepared help the process of an inspection go more smoothly; it can also help protect you as an employer as well as any of your employees from unnecessary aggravation and potential legal liability. Should an OSHA inspector want to speak with one of your employees, the employee does have the right to decline should they choose to do so. Employees also have the right to have someone present should they so choose, as well as the right to have the interview done privately with no one else present. Legal representation present is also allowed should the employee want it or feel more comfortable, all the employee must do is advise the inspector that legal representation is requested. Remember, to let your employees also know that any employee that agrees to an interview, may decide to end the interview at any time should they feel uncomfortable or change their mind. And most importantly make sure your employees know that you as an employer will never retaliate against an employee for participating in an OSHA interview or forever telling an OSHA inspector the truth when it comes to answering any questions they are asked during the inspection
