What should be done with Professor Smut? Professor Smut should be fired from Edinboro University. For the following reasons he violated the First Amendment, academic freedom, and may have caused damage to the students. The First Amendment states that, “Congress shall make no law respecting an establishment of religion or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.”
Professor Smut violated academic freedom, “The standard established in these cases requires a plaintiff who alleges a hostile environment

“Pornography that is far more violent and explicit has flooded the market, and this has been accompanied by a commensurate increase in the number of sex crimes (Davis 14).” Sexually violent pornography is a leading cause of sexual offenses; it influences men to believe that women enjoy being forced into sexual activity and that they enjoy being physically hurt during intercourse. Showing pornography in class wasn’t the problem; the problem was the effect it had on the students. The porn only had an adverse impact on the class because it was violent pornography. If Professor Smut showed soft pornography to the class, it would’ve had a less negative impact. None of Professor Smut’s students were warned about the course or its content ahead of time. He has the right to show pornography in class because of academic freedom, but the effect on the students could get him prosecuted.
Men and women take and view harassment differently. “In the absence of any requirement that they take account of the plaintiff’s gender, they may—or they may not—tailor the standard for sexual harassment to the perspective of the particular plaintiff in the case before them (Rutherglen 6).” There are also differences in behavior of men and women. Men are more aggressive and women are more sensitive. The pornography would affect the women more than it’ll effect the

“Forms of expression that are not obscene and that do not aid independently illegal conduct constitute protected under the First Amendment (Rutherglen).” The pornography that Professor Smut showed in class was obscene, that’s why the First Amendment doesn 't protect him. “The belief that pornography diminishes equal opportunities for women in employment, education, and politics and encourages men to treat women as second-class citizens (Baron 364).” City councils and courts have accepted that controversy with very little supporting evidence. An experiential study of the relationship between pornography and gender equality has significant policy and judicial effects. Obscene is offensive or disgusting by accepted standards of morality and decency.
In conclusion, Professor Smut should be fired from Edinboro University. He violated the First Amendment, the Academic Bill of Rights, and may have caused damage to the students. It is proven that porn causes men to be violent. Men and women take and view harassment differently, so the reactions of porn will differ from person to person.

Koppleman’s essay attempts to look at the obscenity law what he calls the ‘obscenity doctrine’ and its usage of the phrase ‘moral harm’. He criticizes the law as he feels that it is too crude and is not workable hence it should be abandoned. Koppleman also believes that the fundamentals of the law have never really been addressed adequately and what the law seeks to protect seems to be misunderstood in some sense. Koppleman takes the side of the conservatives over the liberals and attempts to present an argument that holds both viewpoints but does justice to the conservative argument.…

I, _______, agree that school officials should be able to remove student publications when they believe material is unsuitable for younger students, or for reasons it could possibly disrupt the educational curriculum. If students are allowed "freedom of speech" other students could be slandered indirectly such as what occured in this case or fights may ensue due to disagreements. Yes, we as Americans have rights to speak our minds freely, but most students are minors and are under the supervision of the school. The school has the right to control what is allowed within its walls and must moniter students' doings in order to ensure the safety and eduaction of all students.…

Marvin Pickering was a high school science teacher from Will County, Illinois who was fired by the Board of Education for writing a letter to the editor. The letter was published in a local newspaper and contained many negative and inflammatory statements toward the school board regarding their use of taxpayer’s money. Specifically, Pickering was upset about the use of bond money to athletic programs, instead of fixing facilities and paying teachers. The Board of Education concluded that Pickering’s letter was “detrimental to the efficient operation and administration of the schools of the district” (Essex, 2012). Pickering argued that being fired for writing a letter as a private citizen violated both his First and Fourteenth Amendment rights to Free Speech and Due Process under the U.S. Constitution.…

This is viewed as too broad and vague by the Free Speech Coalition. Under Miller v. California pornography can only be banned if it is considered obscene and without redeeming social value or rather if it would offend the average person. The problem with the CPPA was that even film and art, for example ideas produced centuries ago would be considered a violation. According to the First Amendment there is a difference between actions and words; although, certain categories of speech are protected especially those concerning children, those protected categories were not included in the CPPA. The speech used in the CPPA was not remarkable enough to persuade others to break the law; therefore, it cannot be banned. Because the language used was much too vague it was ruled that the prohibitions of the CPPA were overboard and…

    3. Should this incident be limited to the class, or should the principal and parents be notified? I believe this incident should encourage a school wide learning situation, in which attention is brought to all students about the seriousness of sexual harassment. I also believe the principle should play apart in this event, as well as the parents. Not only the parents of those students involved in the incident, but all parents.…

In Colleen Flaherty’s article “survey sheds new light on faculty attitudes and experiences toward trigger warnings” he mentions one example of “a student at Crafton Hills College and her parents called for several graphic novels she’d been assigned to be banned for what the student called their ‘shocking’ sex and violence.” In this example, the student calls for the graphic material to not be flagged but banned although it is important to the lesson. If college level students are allowed a free pass on a lesson due to its graphic material, then they will enter an uncensored society with a false sense of…

Catherine Mackinnon, in her piece called “Only Words” articulates why government intervention is required in order to prohibit the continued subordination of women as witnessed in the American Booksellers v Hudnut and the R v Butler cases. Mackinnon makes explicit reference to the R v Butler case, wherein the Canadian courts recognized that the undue exploitation of sex and pornography inflicts harm towards women. (Appendix A). Commenting primarily on the second test identified in R v Butler , the “Degradation and Dehumanization test”, she articulates that obscene pornographic material, particularly pornographic material lacking artistic merit (i.e. Pornographic material which depicts the subordination of women), causes great harm to the female in society.[1]…

I think pornography can definitely lead to rape because not everyone who watches porn gets sexual gratification out of it. So the only choice they believe they have is find a girl and rape her, after she tells him no. The more pornographic material that is exposed, the more likely a female is going to be raped, like Diana Russell stated, porn is the main element in rape cases. It is NOT okay for any female to held against her will and forced to have sex because a man can't get sexual gratification out of watching porn. NO MEANS NO! And that's the way it should be.…

The majority of education professionals treasure the protections that are a result of academic freedom. However, the protection limits aren’t clearly defined. Many educators believe that academic freedom gives them the right to comment on anything, anywhere, and to anyone, as well as participate in behaviors that the majority of observers consider inappropriate in workplaces (Ekstrand and Wallmon 173). In fact, it is worth noting that academic freedom is used as the excuse for unprofessional and abusive behavior.…
