Prosecutor Forbes Court Case Study
The court should appeal the incorrect actions taking by Prosecutor Forbes for removing the only two African-Americans from the jury stand. Prosecutor Forbes actions were a races act due to the fact, that all jurors should have the right to attend regardless of the race, nationality or gender. The only reason Forbes could remove the two African-Americans from the jury, is if both of the jurors were a close friend of the defendant Woodson. Then the prosecutor has the right to remove both jurors from the jury. If both of the African-Americans attend the jury stand, they can go in favor of Woodson and potentially the jurors will not have a unanimous decision for the final verdict. In the jury trail, the plaintiff and the defendant in the jury selection could reject one of the jurors without having a reason in addition, certain numbers of likely jurors who appear to have an unfavorable bias for the Woodson trial. …show more content…
Prosecutors are not supposed to select certain gender, race or age for the jury selection. The important for the plaintiff and the defendant is to have jurors who are not in favor of any involved parties. In cases were a lawsuit involves significant amount of money, the voir dire has become extra complicated over time, so now attorneys use skilled jury selection services to help them pick analytical data to select the perfect jurors. Attorneys think with the option of selecting professional jurors can help their clients win cases.     According to the song, it had all been decided before hand. The District Attorney (D.A.) was “[practicing] all his lines in the mirror.” He knew what the outcome was going to be, and so did everybody else. They must’ve all “read the morning paper, The headline [read] “the man hangs” but the jury doesn’t.” The D.A. doesn’t have to say anything to convince the jury over- a hung jury is an undecided jury-they agree with what the newspaper says. The man is already hung. Just like in TKAM, Tom Robinson had no chance to win. But even if some of the jury isn’t convinced-Mr. Cunningham-the Prosecutor can just “pay to close it like a casket.” Even the witness is payed off he is, “Too well dressed for the witness stand” AKA he just got new clothes. Hmm, maybe a new paycheck?? The defendant has no chance, he either “[Hangs] on a rope, or bated breath.” The death penalty will be served, or the suspense will end him. Game over. To add to the injustice of this case “The press prays for whichever headline is worse.” The accused has nothing going for him. The jury, either they get payed to vote against him, or they agree with the Prosecutor. The witness already got payed off to say the ‘right’ thing; and the press just doesn’t care-unless it will help them sell papers. That dude couldn’t catch a break. The 5 minorities arrested had DNA proof-DNA that is I believe 100% accurate, they were innocent and no amount of arguing could prove it another way-yet they still were convicted.     To demonstrate and answer some of my unanswered questions Kennedy delivers strong cases that clearly shows that race has the potential to impact trial outcomes, such as the Swain v. Alabama and Batson v. Kentucky cases. It is obvious that the fairness of the criminal justice system has been called into question. I never knew that the justice system history in relations to the peremptory challenge caused disadvantages upon blacks until reading Kennedy’s arguments; my thoughts on the peremptory challenge are that it is unfair because a potential juror’s gender or racial orientation should not be grounds for a peremptory challenge. However, I suggest that the larger issue is that it’s easy for lawyers to hide their motives for discriminating against some groups. Equally important, it’s easy for the courts and lawyers to conceal discriminatory motives for so-called peremptory challenges of prospective jurors.     The jury must reach a verdict after considering all of the evidence presented. The jury helps to contribute to a impartial and fair trial. The jury system in To Kill A Mockingbird had a large impact on Tom Robinson’s case. This case was an example of a bias and unequal justice system, fuelled by the racial views of the town.
