7. Racial profiling: is defined as any law enforcement officials that affiliate themselves with race, ethnicity, or national origin to while arresting or working in a case. It is the act of suspecting or targeting certain group of people based on
their appearance. There is an officer in the movie is affiliated with the KKK. His affiliation with the KKK indicates he uses racial profiling and bias in his work. This wrongdoing in the law enforcement is not to be tolerated and it makes the officer a dangerous character in the justice system. The officer abused his power by assisting the KKK in the kidnap of Ellen. The officer stopped Ellen under the guise of a traffic violation and asked her to step out of the vehicle.
8. Insanity: is a plea a defendant may enter to justify that his actions were caused by his mental illness. The reason of filing insanity is that the defendant is seeking for an excuse of his action. The examination is to see if the defendant did not have the control or understanding of what he is doing. Brigance decided to use insanity in his case to his client. In the meanwhile, Brigance was also worried about the outcome of the case if people finds out that he knew about what happened before it happened and remained quit.
9. Preliminary hearing: is the proceeding before a judicial officer in which three matters must be decided: whether a crime was committed, whether the crime occurred within the territorial jurisdiction of the court, and whether there is probable cause to believe that the defendant committed the crime. Hailey was arrested because he committed the crime in plain view of other officers in the courthouse which covers two-thirds of these requirements.
10. Motion: An oral or written request to a court at any time before, during or after the court proceedings asking for findings or decision on the case. The motion here was denied by the judge saying that he doesn't see anyhow Hailey can be free. The judge believes that Hailey was aware of what he did and was in full control of his mental facilities. Also in the movie Hailey was asked if he thinks someone who raped his child deserve to die. Lawyer Brigance told him not to answer the question, but he got overwhelmed by the question and he lost his temper and said that the person deserves to die. By Hailey statement, the Judge decided to set for jury and denied the motion.
