I then approached the vehicle, at which time I smelled the odor of marijuana coming from within the vehicle. When I reached the drivers window, I observed the driver, who was later identified as Matthew O Hicks (DOB 10/01/1992), was the sole occupant of the vehicle. I then instructed Hicks to exit
the vehicle, at which time I searched him due the odor of marijuana. Hicks then stated he did not have a drivers license, and when I asked him for his SSN number he stated he wanted a lawyer, I then advised him I was not required to provide him a lawyer during a traffic stop. After several attempts, Hicks provided his name and date of birth, which I ran through dispatch and determined he had an expired drivers license. Officer A. McNair arrived and stood by with Hicks, while I conducted a probable cause search of the vehicle due to the odor of marijuana coming from within the vehicle.
During the search, I located 6 bags of marijuana in the center console of the vehicle. I then photograph the evidence prior to removing it, once it was photograph, I secured it in my patrol vehicle for transport. During a further search of the vehicle, I located a clear mason jar containing a plastic bag inside a black book bag which was on the passenger floor board of the vehicle. The jar was also photographed prior to be placed in my patrol vehicle. After completing a search of the vehicle, Uniques Towing was summoned to the scene and impounded the vehicle.
Hicks was transported to The Gulfport Police Department where he was turned over to Det Thomas King. After speaking with the Detective, Hick was processed and transported to HCADC. Hicks was charged with felony possession of marijuana, and given a citation for unlawful tint, along with expired drivers license. The evidence was placed into The Gulfport Police Department evidence facility, along with a crime lab submission form.
