Should Social Care Happens Differently Than Commercial Host?
The reasons why I believe that the law should treat social hosts differently than commercial hosts are for various reasons. My main argument is I believe that the duty of care should be imposed on commercial hosts because unlike social hosts they are making a profit due to the fact that they are a licenced establishment. This means that the government and the rest of society have entrusted them to serve alcohol to members of society and also to also take care of the people who drink at their establishments. Before you can serve alcohol you have to get a liquor licence, and that licence teaches you when to serve alcohol and when someone has become too intoxicated for more alcoholic beverages. Jordan House the Supreme Court of Canada decided to give Menow (he was drunk at a hotel and was ejected from the hotel then hit by a car), so they decided that not only would drop the appeal made by the hotel but would also make sure Menow was compensated for the damages caused to him by the driver (), and the hotel. Menow won the case and was also awarded compensation for his damages, the reason for this is similar to my reasons why I believe commercial hosts should be held accountable (i.e. ejected him when they knew he was intoxicated). The impact of personal autonomy of guests by social hosts who provide alcohol to the guests is no matter what the guests would do after leaving the party it would be the host’s fault for providing them with alcohol and not checking their state before the left. I do not believe this is an acceptable limit on the autonomy in light of the harm that would be prevented because of the hosts being liable and therefore checking to see if they are in a safe state of mind before they left. I believe this because guests would take advantage of this and abuse
