Small Claims Trial Essay
I was overwhelmed with excitement, as I was about to witness my first small claims trial in the reputable small claims court located at 7765 Hurontario Street, Brampton, which was repetitively used as a source in the small claims textbook. To my surprise there were two buildings, the large one being the criminal court while the smaller one was the small claims court. These seem to be the main cause of confusion for many people including myself. This is because the address for small claims on our books was actually for the criminal courts instead. I failed to understand why they could not create a way to distinguish them. When I finally arrived at the small claims court, I was enthusiastic to see the endless amount of people …show more content…
This is interesting as it came from the common law system where judges sat in a royal courts of justice that were established by English Kings in 1066CE. These principles have travelled through history and still applicable to this day. The judge came in well informed and prepared on the case before entering the trail. He was introduced to the plaintiff, Vino Petal, who was represented by a paralegal whereas the defendant, Waseem who was self-represented. The plaintiff was trying to prove breach of contract and fraud. After which the judge declared the case as “a commercial deal gone sour’’. The judge became furious when he had learned that Waseem showed a lack of due diligence as he did not have his small claims court rules. Due diligence is reasonable steps that must be taken in order to satisfy the law. Both parties showed a lack of due diligence that not only caused the judge to become impatient, but also went against the litigants favor. This highlights the significance of Due diligence in the court of law. Yet the absences of it show that you are not only wasting the time of the judge but also disrespecting the court. However the judge had a higher expectation from the paralegal compared to Waseem, who was self-represented. Then judge then said “ Mr. Waseem I am not your attorney but I will state the procedure for you”. As done in small claims

When doing a financial report the general goals are pretty obvious. A financial report is a way to show the intake and the out take of a business such as the rent of a building which would be the debit. The credit would be an example of common stock. As I was working on Appendix C I had to stop and think about debit and credit and what they actually meant. Debit is a source of an outcome, which means that money is being removed. Credit is when there is income being added. The steps that I took in the recording process were to first start with number one which was stockholders invested $25,000 cash in exchange for common stock. When reading the problem I noticed that the stockholders invested 25000 cash in exchange for common stock, which to me it meant that there was no debit happening here, it was a credit for common stock. As I keep going through the numbers there were some spots that confused me such as hired secretary for 2000 a month and paid secretary 2000 a month. I decided that the hired a secretary for 2000 was for credit because a secretary is a needed service, but I also added it in the debit because the secretary is being paid which means money is leaving. After going over every number problem I realized the steps that I am taken have to really be considered because with each step the answer is in really reading each number and searching for specific words such as received, or purchased. I think the principle of accounting do support the steps I have taken, because reading and looking for specific signs can help make things easier to understand, which is a very good thing when doing anything financially.…

Author Safian defines the False Claims Act “law specifically forbids the transmission of claims with the intention of gaining reimbursement under false conditions” (Safian, 2009). This means that when a claim is submitted with false information to increase reimbursement it violates the False Claims Act. This behavior also can be identified as intentional and will be considered as fraud. There are heavy consequences for violating this Act and the behavior associated with violation should not be taken lightly.…

Going to court was a new experience for me, since I had never been to a court here in the United States. When I arrived to the court, on one side of the room was the plaintiff with his lawyer Andrew McCormick and on the other side, was the defendant, who was being defended by himself. The plaintiff's attorney presented his opening statement to the judge, arguing that his client Mr. Weinberg was claiming $85,246.87 in disparagement of property and for breaking a leasing contract. When it was the defendant's turn, he did not give an extensive opening statement, he simply said that he was not going to pay what the plaintiff asked for since he had never set a foot on the property and that he was in his right to cancel the contract within 72 hours.…

Many people tend to criticize our legal system for being too onerous. In our legal system, there is a three tiered court system in place of both State and Federal court system. Moreover, there is the intermediate court, also known as trial court, and there are the appellate or “higher” court. The higher courts are responsible for reviewing the verdicts that were previously made in the trial courts. However, when dealing with a trial court, the purpose is to handle civil matters. In this court, both sides represent their case, providing evidence to allow the court to gain a better understanding about what happened. In the trial court only one judge is present in the courtroom in which he is monitoring what evidence is or is not appropriate to be submitted during the trial. However, on the…

Every day people knowingly or unknowingly enter into series of contracts. This may be in the form of purchasing an article from a shop or by purchasing a railway ticket or by numerous ways. In modern societies, because of increasing complexity, there has been a practice of concluding contracts in standard form. One such instance of a standard form of contract is contract of insurance. Thus, standard form of contracts are those kinds of contracts were parties do not sit together to bargain the terms of the contract. One problem that is likely to arise with regard to standard form of contract is that they contain a large number of terms and conditions in fine print which restrict and often exclude liability under the contract. The individual in such cases have no option other than to accept the terms of the contract whether they like it or not.…
