Speculation on Activity by Korean Tenants
Problem: The problem in the case is that there is a speculation on the activity by the Korean tenants because of lack on transparency of the lessee and details on rental agreement. This had caused ethical issues on the landlord-accountability and responsibility, townhouse administrator-responsibility and privacy and Korean tenants-transparency and honesty. Facts: A residential townhouse unit in an exclusive subdivision was leased to Mr. Park for a year. The lease agreement includes a provision that the tenant/s must comply with the Townhouse Rules and Regulation. It includes that unit should not be used as boarding or lodging house or any business that is open to the public. Also, the contract of lease says that there should be a maximum of five tenants. There’s no more specification on who are the tenants. Within a month, the landlord where called by the Townhouse Administrator because of the 5 units of computer that were delivered in the unit. When they inspect the unit, it was found out that there are five male Korean tenants, ages 25-35 who said that they used the computers to send emails. According to Mr. Park thru a written letter, the tenants were his employees who were staying in the unit to study and learn English, and they will go back in his company in Korea. He also stated that there are 6 computers, each of the five computers are for studying English while the sixth computer was for Korean TV channel which is hooked up to a special internet service provider. He assured that the use of premises doesn’t violate any townhouse regulation. The landlord was unsure whether or not Mr. Park is saying the truth and he has speculation that something is going wrong. He was aware that there had been residences occupied by Koreans and were raided due to illegal activities. Options: I will suggest to look for a possible loop hole in the agreement such as Mr. Park used the unit for boarding or lodging house. He let his employees to stay in the house for
