Jurisprudential Problem: Cultural Defense
Cultural Explanation/Defense This article began with the arrest of Wilfredo Cordero who had been arrested for allegedly beating his wife Ana Mora. Cordero’s first wife, Mora, offered a cultural explanation. After defining the meaning of cultural explanation, which is define as an explanation for crime (such as homicide) which is phrased in terms of the culture of the sub group or sub culture of that nation it helped me attain a better understanding of what Cordero’s first wife was offering. Learning that Cordero’s first wife Ms. Mora who admitted she as well had been abused by Cordero and explained potential reasons that may have lead to him being abusive. Ms. Mora explains, Cordero grew up in the housing projects of Puerto Rico which she later described as a “macho environment” where men including women alike often accepted domestic violence as normal. After having read this small portion of this article it caught my attention to want to read on seeing in some areas some may accept domestic abuse. “As Americas deal with domestic abuse more openly, some immigrants’ view of family violence as nobody else’ business beyond the reach of social agencies – is at odds with their new cultural environment, where it is a crime.” This statement made in the article brought my interest in a whole other level. I was interested in learning more about different cases on domestic situations and different cultures who is pro domestic violence; looking at it as “nobody’s business” and who is most likely opposed to it. I learned having read this article there are many people out there who are opposed to domestic violence along with cultural defense. Counselors who work with battered women and abusive men from many countries see cultural defense
