TDA 234 Know About Current Legislation
[TDA 2.3.4] Know about current legislation, policies and procedures for confidentiality and sharing information, including data protection.
Within our school handbook the following is stated….

Staff are reminded that they must not pass on or discuss information about another child with another parent/carer/member of the community. This can include information such as information about a child’s peers such as names, addresses, telephone numbers, dietary requirements or other personal information. If staff are unsure, please speak with one of the senior managers. Parents may not take videos or photographs of other pupils. Staff are reminded that sensitive information about children must not be discussed/relayed to other school staff in the staff room. Data/information/photographs of children must be stored on an encrypted memory stick or password protected computer. Please ensure that you do not share your password with other staff/children. Please don’t take photos of children on mobile phones.
Confidentiality is paramount within a school environment. Recently I have been on training courses for specific children for complex medical needs. My understanding is the needs of these children should only be discussed with the parents directly and/or other teachers involved with this child. The cases may also be discussed with the SECO at our school. Other than discussing this information with these people if I question who needs to know what I will always check with a member of our SLT first.
The Data Protection Act
The Data Protection Act controls how your personal information is used by organisations, businesses or the government.
Everyone who is responsible for using data has to follow strict rules called ‘data protection principles’. They must make sure the information is: used fairly and lawfully used for limited, specifically stated purposes used in a way that is adequate, relevant and not excessive accurate kept for no longer than is absolutely necessary
