Tobacco Products Directive Case Study
The legal dimension of the proposal for the Tobacco Products Directive (COM(2012) 788 final).
One of the most dangerous health problems in the world is smoking tobacco. Only in Europe, 650.000 people are killed every year because of tobacco use and globally, tobacco causes 6 million deaths per year. The use of tobacco products raises the blood pressure and damages blood vessels. (World Heart Federation, n.d.) Also, every year people that are exposed to second-hand smoking, 28% of them being children, are being killed with an amount of 600.000 people. (World Heart Federation, n.d.)

(European Commission, 2016) Manufacturing and selling tobacco products with characterized flavors is prohibited and also the use of additives such as vitamins because it is not allowed to create an impression that tobacco products are healthy. Also, additives such as caffeine and taurine, additives that are associated with energy are also prohibited. It is also not allowed to use flavorings in filters, papers and packages. The Member States their manufactures tobacco products have to have list of all ingredients used in the process of manufacturing tobacco products. Also, the importers of tobacco products have to have a list with the products with the brands, types and their emissions and yields. (Europa EU, 2014) The manufacturers and importers also have to inform the authorities of the Member States about the products. Also, Member States want reports on sales data per products from the manufacturers and importers. Also, each Member State has to report these numbers on an annual basis. The European Commission took care of the phrasing of these health warnings and they defined the position, format, layout and design. All this also includes the font and background color. (European Commission, 2012)
Member states shall insure that each combined health warning is displayed as close as equally possible for each brand. The European commission shall adapt the text warnings, establish and adapt the picture library for the pictorial warnings. It shall also define the layout , format, position, design and proportions of the health warnings. The commission shall also lay down the conditions under which health warnings may be broken if it intervenes with visibility of the before mentioned measures. (European Commission, 2012)
There are more detailed rules for the shapes and sized of these unit packets. This is so that it is ensured that everything is fully visible before opening a package.
