Is the intentional pain that an individual experiences justified by the possibility of preserving the lives of many? Torture is the used as a weapon, but in reality does it work? The purpose of this essay is to identify what the motives are for using torture, the effectiveness of torture, and important issues or flaws with the entire process of torture.
Motivation
The United Nations Convention against Torture (UNCAT) defines torture as:
'torture' means any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him for an act he or a third person has committed or is suspected …show more content…
However the level of skepticism would will be present and will result in the torturer spending valuable time determining if the information received is authentic or not.
(in) Effectiveness with torture
Using torture to as a way to gain intelligence involves a tremendous amount of assumptions. The Torturer is assuming that they have the correct person, they are assuming as the victims level of involvement and guilt in the situation, and lastly by using torture they are assuming that there is no alternative way to extract the information.
Simply relying on instincts or “gut feelings” as a way to solve crime or to come to any conclusion at all, gives the authority figures more control, and possibly a greater sense of superiority. When a torturer jumps to such conclusions with little or no evidence there may be an intensified need for their theories be correct to avoid humiliation among peers. Process Flaws Advocates of torture argue that torture is a necessary tool especially in time sensitive scenarios, like if an individual is the only person alive who knows the whereabouts of a bomb that is set to detonate, resulting in the deaths of hundreds. I could not even imagine how stressful the interview process of this scenario would be, as time progresses and no results are being produced, inflicting pain does not only have the possibility of yielding results but it would also be a convenient way to externalize your frustrations.
The blatant disregard for the fundamental human rights is an example of one of the many issues in Torture. Torture involves no protocol, there are no trial, no rules, guidelines, or even a script that a torturer must follow. Anything goes.
