1.1 Identify the current legislation, guidelines, policies and procedures for safeguarding the welfare of children and young people, including e-safety

The current legislation to safeguard children in England is “The Children Act (1989) and (2004)”. It is the main legal framework around which child protection procedures are orientated. This states the welfare of the child must be paramount in any work with a family; this is known as the paramountcy principle. Professionals are expected to work together, share information and work in a co-operative way with parents.

The Children Act 2004 is an amended version of The Children Act 1989. It states that local authorities and children’s social care are responsible for investigating whenever information is received that gives reasonable cause to suspect significant harm and schools should cooperate with local authorities when investigations are taking place. It also introduced “Every Child Matters”, which is now called “Help Children Achieve More” which promotes four key principles:-
Accountability
Information sharing
Integration
Safeguarding

It states that local authorities and children’s social care are responsible for investigating whenever information is received that gives reasonable cause to suspect significant harm and that schools should cooperate with local authorities when investigations are taking place.

The Government also provides a guidance document “Working Together to Safeguard Children” which tells agencies what their roles and responsibilities are and has introduced a Common Assessment Framework (CAF) for sharing information. It is submitted to the local authority for other agencies to access, even if the family moves areas.
