Walmart Observation Paper
On the above date and time I responded to Walmart, reference a disturbance.

Dispatch advised me that Ofc. Alu was off duty with a male subject who he detained for causing a public disturbance and threatening both customers.

Upon arrival at Walmart, I observed Ofc. Alu with the White male defendant, later identified as Joshua L Arthur. Ofc. Alu had the defendant detained with his hands waiting for my arrival.

I exited my patrol vehicle and heard the defendant cursing and threatening Ofc. Alu by stating "I'll fucking kick your ass.". There were several customers and Walmart employees standing in the parking lot who observed and heard to the defendant. Post Miranda read by card, the defendant became irate and again started to curse loudly stating "I'll fucking kill all of you pigs."

The defendant previously identified himself and was negative for wants and warrants. However, the defendant refused to provide any additional information such as his address.

Walmart Manager, William Dorkowski, requested that the defendant be trespassed from Walmart. I later issued the defendant a trespass warning which he acknowledged to and signed at central booking. Dorkowski also received a signed copy of the trespass warning.

Dorkowski provided DVD video surveillance of the disturbance which was later entered into evidence at the Port Richey Police Department.

The defendant was transported to central booking for processing without incident. While in central booking, the defendant apologized and stated that he became angry and cursed because he was "having a bad day."
