Mr. Gauci, went to the first interview nine months after the initial contact and identified Al-Meghari two years after to which she pointed out as the first weak point of the case. Previous research on memories consistently found that memory fades overtime. In this case particularly, Mr. Gauci works in the retail business where he sees many faces everyday across the period of time of two years. Therefore, unless the customer is a very distinct one than chances are that he will not have memory of it. The next flaw of the case was the exposure to post-event information. This case attracted public and media attention at that time, therefore there were a lot of information
out there during the investigation process. It is very possible that Mr. Gauci’s memory was contaminated by information out there. Next, Loftus found that from witness identification process, there were some differences between Mr. Gauci’s description. In the initial interview process, Gauci described the person about 6 feet and around the age of 50, while Al-Meghari was less than 6 feet and around 30s. His description of the suspect changed by the time of the trial to be matched with Al-Meghari. Another aspect that may be flawed was the fact that Gauci has different race with Al-Meghari, cross-racial identification has been known as unreliable. Based on these points, Loftus came to the conclusion that Al-Meghari may have received an unfair trial.
