They had to decide whether or not to allow all citizens the right to bear arms or if there should be requirements. They came to the conclusions that, “a well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed”. This amendment has been interpreted in many different ways in the past however, the Framers intention was to have the members of the militia ready at a minutes notice to go and protect the freedom and liberty of the country. However, just like today, there was controversy over what the Second Amendment was suppose to mean to the country. James Madison argued in the Federalist paper 28 that everyone should have the right to bear arms when he wrote, “ Little more can reasonably be aimed at with the respect to the people at large than to have them properly armed and equipped ; and in order to see that this be not neglected, it will be necessary to assemble them once or twice in the course of a year.” In Madison’s and just about every other federalist opinion, every person should have the right to bear arms. If the justices in the Supreme Court had interpreted that Second Amendment in a different way than Miller and Layton could have gotten off without any punishment. Under the National Firearms Act, the men had to pay a tax of 200$ to transport this weapon interstate. With this case it made it okay for the government to impose a tax on the transportation of firearms throughout states. This decision came at a time in the country where the country was having a lot of problems with firearms and gangsters and this decision made it much harder for these people to move their firearms.
