Why Torts Went Wrong
As we have already learned in class, a tort is a form of wrongful action that brings or causes harm to someone else that can lead to a lawsuit. Some torts are intentional, negligent, or strict liability. If you were intentionality trying to hurt someone or you were being reckless, you weren’t not making safe and conscious actions that only affect you. There are many different forms of intentional torts that are committed every day and there are consequences for those actions. The main intentional torts that are committed are: battery, assault, fraud, false imprisonment, intentional inflection of emotional distress, and defamation. Battery and assault seem like very similar concepts and are easily mistaken. Battery is when you physically come in contact with someone else. Assault however, is basically like a verbal threat to harm someone but not actually hitting someone. Fraud is considered “lying for someone else” or “intentionally deceiving others.” This becomes an issue in law because people rely on what other people say. False imprisonment is exactly how it sounds; someone with no legal authority is falsely keeping someone in confined area. An intentional tort can have severe consequences so I am glad I learned all of the differences between these actions. Regarding the CRAAP test, this resource scored pretty well. Something the source was missing is a current date and author, which can really affect the authority of the source. However, it was completely relevant compared to what we have learned in class. I look at a couple different options but I thought this had the best information for me to be able to discuss the topic. I thought it was very accurate because I made sure to cross check the

    Tort law is a type of law that is designed to offer remedies to civil wrongs. Unlike contractual damages that occur, where responsibility is predetermined, tort law is designed for someone who is legally injured to be able to recover damages from the person who is deemed legally responsible, or liable for such injuries. Tort law is broken down into three main categories, negligence, strict liability, and intentional tort. In negligence tort one is accused of causing damages through their carelessness. After accusation of negligence the plaintiff must be able to show that the defendant had duty of care, and that a breach of duty had occurred that caused the damages. Strict liability is a legal doctrine that makes someone responsible for damages caused by their actions (e.g. product liability). Intentional tort is much like negligence, but instead of one causing damages by accident, there was reckless action or intent to cause the damages that occurred (e.g. assault, battery). Tort cases are based on common law, which is laws that have been developed through court decisions, i.e. precedent. However, in certain cases tort law can also be based on statutory law laid out by the legislature. It is up to the court to decide which rule should take a higher standing depending on the case.…
