1.1 Outline current legislation, guidelines, policies and procedures within own UK Home Nation affecting the safeguarding of children and young people.
Policies and procedures for child protection and safeguarding children were put in place through the Children Act 1989 and further changes were made when the act was reviewed changing the way the system is organised and structured thus forming The Children Act 2004. The Children Act 1989 was to simplify the laws that protected children and young people. It was made clear to all who worked with children how they should work together if in the event of allegations of child abuse. England and Wales drew up separate documents with it, it emphasised the responsibilities of professionals towards children who are at risk of harm forming Working Together to Safeguard Children (1999). After the death of Victoria Climbie February 2000 in which the judge in the trial that followed her death described it as “blinding incompetence” by all authorities involved (police, social services department of four local authorities, the NHS, NSPCC and the local churches all had contact with Victoria) as all failed to investigate properly. In April 2000 the Health Secretary and Home Secretary appointed William Laming to conduct a statutory investigation into Victoria death. After investigation the Laming Report 2003 criticised the approach to protecting children in our society, the report lead to Every Child Matters programme an initiative designed to improve the lives of children which then lead to The Children Act 2004. Some of the main features of the Act include: a new Common Assessment Framework to assist agencies in identifying welfare needs, the establishment of Local Safeguarding Children’s Board (LSCB) with statutory powers to ensure that social services, the NHS, education services, the police and other services work together to
