LAW AND ETHICS
General Tips:
Know the acronyms important to employment law laws, defenses, agencies, etc. (ex. ADA, EEOC, ADEA, IRCA, FLSA, BFOQ)
Look at the learning objectives at the beginning of each chapter. If you are able to meet those learning objectives, you will do well on this test.
Look at the facts in the cases and how the court applied the law to the facts.
The midterm is available on Blackboard starting at 9:00 p.m. on 2/25/14 until 7:00 p.m. on 3/4/14.
You must take the exam in one sitting and it is timed. You have one and a half hours.

Chapter 1
Understand who is an employee and who is an independent contractor and know the risks of misclassification.
Understand the legal parameters of non-compete agreements.
Understand the definition of employer.
Chapter 2
Understand the concept of stare decisis and precedent.
Understand the concept of at will employment and know the exceptions.
Be able to distinguish between disparate impact and disparate treatment. Know the defenses available to employers.
Understand the remedies available to employees.
Understand retaliation claims.
Chapter 4
Understand what the employers concerns may be through the recruitment, application, and employment process.
Know generally the laws that regulate these processes.
Understand the concept of negligent hiring.
Understand the difference between eligibility and ineligibility testing.
Chapter 5
Understand the basis for affirmative action.
Know the three types of affirmative action.
Understand the concept of reverse discrimination as it is described in the book.
Chapter 6
Understand that Title VII prohibits race discrimination
Racial discrimination may be by way of disparate treatment or disparate impact
Disparate treatment may be shown by direct or indirect evidence
Race CANNOT be used as a BFOQ
Be able to identify ways that race and color discrimination are
