What do you think would be the advantage or disadvantage of the UK Bill of Rights? Do you think that there are alternative to either our existing arrangements or to a UK Bill of Rights that would achieve the same benefits? If you think that there are disadvantages to a UK Bill of Rights, do you think that the benefits outweigh them? Whether or not you favour a UK Bill of Rights, do you think that the Human rights Act ought to be retained or repealed?
The advantage to a UK Bill of Rights would be that it would sit alongside our Human Rights Act, as it does in many other countries and therefore we would still have the security of the Human Rights Act if the UK Bill of Rights did not protect us from certain elements which were in the Human rights Act but not the UK Bill of Rights. It would be unparalleled for the UK to scrap the Human Rights Act, to put in place a stronger protection for us such as the UK Bill of Rights. A Disadvantage would be that no one actually knows what a UK Bill of Rights would look like or contain, so it’s hard to say whether there are actually any advantages or disadvantages, the advantage which I mentioned above about the UK Bill of Rights sitting alongside the Human rights Act could either be an advantage or disadvantage depending on what the UK Bill of Rights may or may not contain. It is also thought that the Human Rights Act covers the basic minimum rights for people in the UK and therefore a UK Bill of Rights is not necessary. It is also concerning that by replacing the Human Rights Act with a Bill of Rights, would significantly weaken our human rights protections in the UK. The Human Rights Act should therefore be retained intact.
