reforms the health care industry as we know it including health care providers and health care insurance industry. The Affordable Care Act (Obama Care) is all about cutting costs related to health care and to provide affordable health insurance to all American. Close to 44 million Americans are currently without health care insurance. One of the major things Obama Care will do is help these individuals to get h health insurance through expanding Medicaid and Medicare programs and assist those Americans who cannot afford health care. Medicaid will expand and will cover over 15 million uninsured low income Americans. Affordable Care Act requires almost every American to purchase some a health insurance by the year 2014 or face financial penalties of not having a health insurance ("Obamacare Facts: Obama’s Health Care Reform", n.d)..
Affordable Care Act was created as a result of the constitution because in the constitution it states that the constitutions commerce clause authorizes Congress to regulate health care, which accounts for 18% of America’s GDP, therefore the law seeks to expand the insurance coverage and lower the cost of care for Americans (Elauge, 2013).
That particular provision of Act is deemed to be unconstitutional. However we will not the be the judge of that, Supreme Court will decide if federal government can regulate economic inactivity under the commerce clause of the constitution. The issue with Affordable Care Act is that it forces taxpayer that does not to pay a tax that is equal to one percent of their income in 2014 and 2.5% in 2016 (Obama care facts, 2013). Another provision of the Affordable Care Act is to expand Medicaid health care program by extending eligibility to millions of low income individuals starting 2014. States are arguing and challenging the Obamacare and urging that it is giving them an ultimatum to expand their share of administration and Medicaid costs with the risk of losing that funding if
refused.
Affordable Care Act has good and bad ramifications. The Affordable Care Act creates and ensures that the quality of care is maintained and if those qualities of care are not maintained then the companies will have to give a premium rebate to those consumers. One of the provisions of the Affordable Care Act to be deemed affordable is the health care insurance provided by the employer must pay for at least 60 percent of covered health care expenses, and employees may not be forced to pay more than 9.5 percent of their family income. This may affect millions of business and if the business fails to provide such coverage or the coverage a penalty is $2,000 per worker in assessed (Murray, 2013). This may significant increase business overheads and in return will increase the prices of the products and services to keep up with the increased overhead. The business will also increase layoff and make the remaining workforce more efficient.
