Situation
It seems to have been established by America that children to not have the mental capacity to make rational decisions. It is for this reason that we do not allow them to watch R rated movies. That we don’t allow to them to purchase alcohol or tobacco. Why we don’t let them get their drivers licenses until they’re 16. It can be agreed that children are not mature enough to understand the concept of cause and effect.

Problem
That is, until they commit a crime. As soon as someo ne under the age of 18 violates the law, it seems completely rational to treat them as adults. According to the U.S. Department of Justice, some juvenile cases get transferred to adult criminal court through a process

Some states try juveniles of ANY age to be tried as adults.
How can we limit the privileges of children because they’re too young, but then treat them as adults when they commit a crime? This is an act of hypocrisy.
Even when a teenager gets their driver’s license, there are still restrictions until they turn 18. According to the California DMV website, in the state of California,
Shows that in America even a licensed driver is not responsible enough to even have their friends in the car.
Another example of the fine line
According to The Journal of Criminal Law and Criminology, someone who is 18 may not engage in sexual activities with an individual, who is under 18,

So if we don’t trust them with small responsibilities, how can we don’t say “oh no he’s just a kid” in the one situation when it could help him
My point is that based on the laws and regulations regarding those under 18, America has established that juveniles are not mentally capable to make rational decisions.
What’s worse is that when a juvenile is tried as an adult, the jurors usually receive no instructions regarding the defendant’s

In the Article Kids Are Kids-Until They Commit Crimes by Marjie Lundstrom, Democratic State rep. Ron Wilson stated “You want to throw an adult book at kids? Lower the voting age to fourteen (87). Wilson is raising the issue that the judicial system will deem kids to be kids for alcohol drinking or voting until they are of proper age, but they are treated as an adult if they murder someone. Little does the judicial system know that they are robbing these kids of their chance of having a second chance. Lundstrom makes a clear statement that when more and more kids are sent to an adult prison, more lives are lost and these kids will not have anyone to guide them to the right path ever…

One of the hardest decisions that judges have to make is sentencing a juvenile to be tried as an adult. With the increase in violent crimes in America today, juveniles are often found in the front line of media for violent crimes. Within society as a whole, those who are under the age of 18 years old do not function as adults, which is why the law protects children from the consequences of their actions. With the harshness and severity of crimes committed by juveniles…

The judicial system was created to protect and hold stability in society which is why two systems were put in place, the juvenile system and the adult system. However, recently the boundaries for these two systems are growing weaker as serious juvenile offenders are getting tried in adult court. Juveniles are not authorized to drink alcohol, sign a document, gamble at a casino or vote till they are an adult. Regardless to the crime they have committed, a juvenile is a juvenile and an adult is an adult, therefore sixteen year olds should not be tried in adult court. Sixteen year olds being tried in adult court is wrong because they are able to effectively reform, their brains are not sufficiently developed and they are vulnerable to adult prisons.…

How can they possibly be tried as adults, when they are physically incapable of thinking like one? Juveniles are not allowed to drink, drive, get married, and if they sign legal contracts, their signatures are invalid. Why? Because adolescents are physically incapable of making mature, responsible, well-processed decisions; and this isn't just because of lack of inexperience in life. Adolescent brains are not fully developed until at least the age of 20. They lack the prefrontal cortex, the lobe of the brain that helps with reasoning and judgment. Teens also do not have a fully developed cerebellum, the area of the brain that helps control impulse. Without these two physical characteristics that separate the men from the boys, teenagers can not possibly be expected to endure the same consequence as fully matured adults.…

A teenager should not be tried on the same level as an adult, if they can not do things an adult does. Juveniles are too young and know little about the world; therefore, they should not receive the harsh punishment that adults are being given. Since we are the parents of our kids “It’s why they can’t smoke, or drink, or go to R movies without our OK” (Lundstrom). Adults are lot older, intelligent, mature than teens; therefore, they should not be tried on the same level as adults. Although minors have some knowledge their brains are not matured like adults to make right and wrong decisions. It goes far as beyond to saying teens will not know what they did wrong until they are told. In the article “Juveniles Don’t Deserve Life Sentences” Gail Garinger states, “Brain imaging studies reveal that the regions of the adolescent brain responsible for controlling thoughts, actions and emotions are not fully developed. They cannot be held to the same standards when they commit terrible crimes.” This shows that teenagers are not capable of making decisions and they can not control what they do, even if it is wrong they will not know. Teens should not be charged as adults for the crimes they…

“The only effective way to reduce and prevent juvenile crime is to balance tough enforcement measures with targeted, effective and intervention initiatives.” Juveniles are children and children don’t know any better and obviously make mistakes. They don’t expect to be caught after committing a serious crime. Juveniles brains are not fully developed until they are 25, but young people recognize them as adults at the age of 18. About 25,000 children a year have their cases sent to adult courts instead of being tried in juvenile courts, whose convicted defendants are usually set free by the time they turn 21. Trying juveniles as adults is not beneficial for them. But it also is a crime. And crimes are crimes whether…

If a minor is not tried as an adult, his or her, case is heard by a judge, no jury and in a juvenile court. Then a judge gets to decide what is in the best interest for the child and the child's family. A lot of children that commit crimes come from screwed-up backgrounds and could use some help getting on the right track. So a juvenile judge could sentence the child to a reform school or a juvenile facility with a rehabilitation program and release as the…

In Kentucky, and in many other states as well, after the age of 18 you are considered an adult. This is the level of majority. If someone were to commit a crime at this age or older they would be tried as an adult. Children under the age of 18 cannot be sentenced to death or to life without possibility of parole. This is because children are physically incapable of making mature, responsible, well processed decisions. Opinions from one person to the next differ as there are several reasons concerning juveniles how they should be treated and tried in criminal cases (Southerland). The issue may be more of a debate as some people would say that kids do not have enough reasoning and lack common sense. Others, on the other hand, would say that juveniles have plenty of brains and common sense. There are strong reasons as to why juveniles should not be tried as adults and should not be eligible for life without parole.…

A movement has taken hold of our country to change the juvenile justice system, and erase any distinction between young offenders and adult criminals. Almost all fifty states have changed their juvenile justice laws, allowing more youths to be tried as adults and scrapping long-time efforts to help rehabilitate delinquent kids and prevent future crimes. It seems to be plain and simple, a minor in this country is defined as a person under the age of eighteen. How then can we single out certain minors and call them adults? Were they considered adults before they carried out an act of violence? No. How then, did a violent act cause them to cross over a line that is defined by age? The current debate over juvenile crime is being dominated by two voices: elected officials proposing quick-fix solutions, and a media more intent on reporting violent crimes than successful prevention efforts. Minors should not be tried as adults in our society today. This is obvious through looking at propositions by our government such as Proposition 21, which is statistics on juvenile crime from specific cases where minors were sentenced in adult courts.…

Determining whether a juvenile is identified as a child or an adult is quite simple. If a juvenile is under the age of 18 then he or she is not an adult and if a juvenile has graduated from high school then he or she is identified as an adult. I believe that if a juvenile has not developed a certain level of intelligence or has not emotionally developed then they can’t be identified as an adult. In addition to that, although juveniles may have developed the sense of knowing right from wrong they may not know what’s right from wrong in the “adult world.” There have been laws passed to permitting juveniles to be transferred to adult court. The process with transferring juveniles to adult courts starts with the seriousness of the offense committed by the juvenile. If a juvenile has committed an offense such as armed robbery or murder then without a doubt there aren’t any excuses for…

The age of the offender will always be looked at upon a court justice system. Well-being of that individual is proven to be over-looked based on the severity of the crime that was committed. As much of a shame as that is, it cannot be helped as that is simply the way of the human heart. This also brings up the inevitable question “what age should an individual stop being considered a juvenile?” Young people who commit…
