A fixed sentence is where judges sentence the criminals to a specific time there in prison based on the severity of the crime . For example a armed robbery might receive a year in prison but an armed robbery can receive five years in prison . The argument with fixed sentencing is someone can make a mistake, not realizing that something is against the law, and receive a long sentence because of it. Although there are high level, serious offenders were addressed with these sentencing guidelines, people who have never even been in trouble with the law finally gets in trouble but receives the same sentence as someone has been in trouble with the law multiple amount of times receive the same sentence. This means that there are more people in prison. The US prison population, is one of the highest in the world. Indeterminate sentencing used to be the rule in every states.
Parole boards decided on release dates. The principle behind indeterminate sentences is the hope that prisons reconstruct some offenders, and that different people give feedback very differently to punishment. Prison officials usually like indeterminate sentencing because the prospect of earlier release gives prisoners the motivation to behave while locked behind bars. The argument with intermediate is according to many people, is that it puts too much influence into the hands of the parole board, leading to irrational and unjust results.for those who may not know parole means that the offender is allowed to serve the rest of her sentence under community watch. The offender is discharged from prison to be a part of the community, but not without some rules being involved. At a minimum, the offender will be required to check in regularly, with her parole officer. Any violation, like an arrest for a new crime or a failure to find and keep a job, can result in the person being sent back to prison also. Essentially meaning that minorities and etc get treated differently or more harshly than other races. While people who deserve a harsher sentence are
released. In my personal opinion I believe a fixed sentence is the best because the sentence can be reduced , any court is going to look at what you have done and if you have been good behind bars. A prison sentence that is obvious and not subject to review by a parole board or other agency. For example, a sentence of six months in the county jail is determinate, because the prisoner will spend no more than six months minus time off for good behavior, in some situations. In comparison to an indeterminate sentence such as 20 years to life and has a minimum term but the release date, if any, will be chosen by a parole board as it is reviewed many times . Going to jail or prison isn't where people should like to be but if you are put in the situation where you have committed a crime and your sent to jail stay on good behavior while behind bars so your sentence can be lessened .
