While at his NTC rotation PFC Thiel was tasked by SFC Graff with being at the trucks at 0630 to begin the duty day. PFC Thiel along with a few others were late to the trucks. As a result everyone in the company lost the privilege of going to the shoppete to get supplies by punishment of SFC Graff. While on guard duty the night before going to the field PFC Thiel was unable to clean his weapon because he did not have a weapons cleaning kit. SSG Gaburri told PFC Thiel to go and buy a weapons cleaning kit and a few other things at the shoppete. SSG Gaburri was at the same formation where SFC Graff had issued the order of, “no one is allowed to go to the shoppete while we are at NTC.” PFC Thiel did remind SSG Gaburri that neither of them was allowed to go to the shoppete as ordered by SFC Graff. SSG told his soldier that it was not that big of a deal and to go anyway. While on his way back to the trucks PFC Thiel went to get his flashlight were he got caught going to the shoppete by SFC Graff. PFC Thiel thought it was ok because he was told to do so by SSG Gaburri. But it was not ok to go to the shoppete because SFC Graff out ranked SSG Gaburri. PFC Thiel was in direct violation of Article 92 – Failure to obey order or regulation. Article 92 covers anyone who violates or fails to obey any lawful general order or regulation, having knowledge of any other lawful order issued by a member of the armed forces, which it is his duty to obey, fails to obey, fails to obey the order, or is derelict in the performance of his duties; shall be punished as a court-martial may direct. First, any person subject to this chapter who violates or fails to obey any lawful general order or regulation.     Article Eighty-six of the Uniform Code of Military Justice makes it a crime to fail to go to one's appointed place of duty at the time prescribed, to leave one's place of duty, or to be absent from one's unit without authority. Article Eighty-six or Absent Without Leave, states verbatim “Any member of the armed forces who without authority fails to go to his appointed place of duty at the time prescribed; goes from that place; or absents himself or remains absent from his unit, organization, or place of duty at which he is required to be at the time prescribed; shall be punished by court-martial may direct.” Being a certain member appointed for a specific duty at a specific time and place and not showing up or showing up late, whilst knowing of the appointed duty. Punishment for violating Article Eighty-six of the UCMJ is left to the discretion of the member's direct chain of command. Whether that be an NCO, Staff NCO, or Officer. The first violation is typically a verbal or written counseling, second a written counseling along with a specific form of deterrence such as: reporting in to the duty NCO every four hours through out the day, even in the members off time. Third violation will usually result in a much harsher punishment such as a Page Eleven, Sixty-one Zero-five, or Nonjudicial Punishment, Court-Martial, and Administrative separation from the service. If taken to Nonjudicial Punishment member could end up losing rank, pay, and be confined to restriction. It is all about accountability. Though normally accountability is an individual responsibility it may become a unit responsibility or the responsibility of a superior to ensure you are where you are supposed to be at the appointed time.     Accountability is defined as, the obligation imposed by law or lawful order or regulation on an officer or other person for keeping accurate record of property, documents, or funds. The person having this obligation may or may not have actual possession of the property, documents, or funds. Though I am aware of the different types of accountability in my case, I failed to ensure one of the most important, which is personal accountability. One of the values in the United States Army, that most seek in soldiers is accountability. Accountability (in this case) means that you can be relied upon to arrive to work and appointments on time, meet deadlines, be in the right place at the right time, and do what needs to be done to complete the mission at hand.
