There are several factors that might affect an individual’s ability to express their views, * English may not be their spoken language. * There may not be enough information about the service therefore the individual is not able to make an informed choice because all the facts are not available. * Dementia could cause problems as the individual may not have the mental capacity to make a decision. * The individual may have suffered a stroke and be unable to communicate verbally.
Different ways of gaining consent to activities or actions such as assisting with personal care are: * Verbal- Explain what task or activity is being undertaken make sure the individual
understands what is being done and ask for verbal consent to do this task. * Gestures - If the individual is unable to speak then clear yes and no gestures could be established such as nodding of the head for yes and shaking for no. This would be obvious implicit consent. * Written consent – The individual can sign to say they agree to the activity or action.
Use of an Advocate – This would be required for an individual who lacks the mental capacity to make an informed choice and is therefore unable to give their consent.
If as a social Care Worker you are unsure of the individuals response then further guidance must be sought, Perhaps by a family member who understands the response and can confirm it. Speak to another work colleague or manager for further guidance. Do not proceed with the task or activity until consent has been clarified. Always document repsonses.
