The gun was found under the passenger seat, but Finish was in the driver’s seat. However, he could have been double parked for a quick getaway and the timing of the event was late in the evening, one must take into consideration the knowledge of the defendant versus the knowledge of his passenger. In the readings that I have done I have found that there are three different types of legal defenses, they are: self-defense, insanity, and provocation. In a case where a person is charged with first degree premeditated murder, if they were to use one of the three defenses the punishment would not be the maximum that is normally imposed depending on the crime and type of defense that is used.…

In the book "The Outsiders" by S.E. Hinton, one of the character's Jonny killed a soca. He ends up running away in the end. That was his first mistake. You don't run away/ flee the town if you know you didn't do anything wrong. Self-defense means that there was nothing he could have done to prevent killing Bob (the soca). (Voluntary) Manslaughter, however, refers to intentionally killing the victim without planning it. In the book, Jonny states if a soca were to ever jump him again, then he would be ready to kill them. Even with that evidence, he still hasn't planned the way, when, or how he would kill someone. He also says "yeah. His voice was quivering slightly. I had to. They were drowning you ponyboy. They might have killed you." He…

In conclusion, second degree murder is classified as killing another with malice, but without premonition or deliberate planning. In other words, it involves killing someone intentionally and spontaneously; the killer didn’t plan it out in the past. It is true that Johnny hadn’t planned the killing of Bob Sheldon. In contrast, we know that Bob wasn’t the one about to kill Pony. Therefore, I believe that the murder of Bob may have been intentional, given the past history between these two…

How can one person decide to take a man's life? How can another man then decide to take a man's life in the act of revenge? Is there a difference to killing for the sake of killing or killing for the sake of revenge, or are they just two different shades of the same color? Many different people of today's society have differing views of what justice is, and how justice should be served to those who are guilty of such crimes as rape, kidnapping, or murder. "Killings", by Andre Dubus attempts to illustrate the life of the Fowler family after Richard Strout shoot's Frank Fowler. From the very beginning of the story, the seed of revenge is planted when Matt Fowler's other son, Steve says, “I should’ve killed him. He bit his lower lip, wiped his eyes…
