While I would understand that James Smith is angry that his privacy was violated, I would try to explain to him that unnecessary jail time is only going to make things worse for Richard. Prolonged exposure to prison can turn people into worse criminals than they were before they went into prison. I would not want to expose Richard to any more drugs or bad influences in prison than necessary. One of the purposes of sentencing is making sure the defendant can become reintegrated into society and live a productive life, while also minimizing their danger to society. Sending Richard to prison for longer than necessary would probably cause him to be more of a danger to society when he gets out and would also cause him to have a harder time becoming reintegrated into society. If a person was killed because of the burglary, I would have no choice but to impose a much stricter sentence. I feel as though my original sentence of only 30 days in prison would not fulfill the purpose of “respect for the victim” and would show a disrespect for the life of Warren Smith and the entire Smith family. In this event, I feel as though I would have no choice but to charge Richard Jones with murder and sentence him to 25 years in prison, with 3 years of probation. By giving Jones a much stricter sentence, one of my goals would be to deter others from burglarizing homes, because you never know who might be inside. This sentence would also show respect for the victim and acknowledge the seriousness of the crime. However, since this was not a violent or intentional murder, I would give Richard the option to plead guilty and enter drug court. Then, following his graduation from drug court, reduce his sentence. I believe that this sentence is strict enough to punish Richard Jones while also showing respect for the Smith family and ensuring that Richard can reintegrate easily into
