Thomas Baker and others who purchased new homes from Osborne Development Corp. sued for multiple defects in the houses they purchased. When Osborne sold the homes, it paid for them to be in a new home warranty program administered by Home Buyers Warranty (HBW). When the company enrolled a home with HBW, Osborne paid a fee and filled out forms that stated the following: “By signing below, you acknowledge that you CONSENT TO THE TERMS OF THESE DOCUMENTS INCLUDING THE BINDING ARBITRATION PROVISION contained therein.” HBW then issued warranty booklets to the new homeowners that stated: “Any and all claims disputes and controversies by or between the Homeowner, the Builder, the Warrant Insurer and/or HBW shall be submitted to arbitration.”…

Tylenol or known as Acetaminophen is a popular pain reliever, since it helps with common types of aches. However, there is no drug that is completely safe. Chris Silas Neal wrote an article titled The Trouble With Tylenol and Pregnancy which was published on September 24, 2016. According to this writer, children born from mothers, who took this medicine during pregnancy, could receive Attention Deficit Hyperactive Disorder (ADHD) or asthma. In his article, Neal targets the heart and mind of his audience: pregnant women. Neal uses enough emotion in his article, provides well thought logic and reasoning, and appears to have good ethics and credibility.…
Antony Flew (1955) introduces the concept of theology and falsification by referring to John Wisdom's parable of the Believer and the Skeptic in reference to the existence of a beautiful garden in the jungle. The Believer asserts that there must be a gardener taking care of it regardless of whether he can be seen, heard or felt, while the Skeptic believes there is no gardener and the garden blooms independently of a caretaker. Even after setting a watch, patrolling with dogs and setting up an electrified fence, there is no physical evidence of a gardener, only the presence of a garden. However, the Believer in the parable does not waiver from his belief in the existence of the gardener despite the efforts of the Skeptic to question acceptance of this person based…
David Norton is single once again, but things from his past are coming back to bite him and it's not looking good. In Touch Weekly just shared that even though Norton is denying that he was abusive to his ex-girlfriend, police reports make it look like there is more to this story. This all went down back in August of 2007, but once you get on reality television people want to know your past business. Now David's past is being brought back up and of course Norton is not very happy about it.…
In the excerpt from the second chapter of Walden titled “Where I Lived and What I Lived For,” Thoreau crafts an intricate argument which advocates for self-realization within every individual. The specific quote I chose from the excerpt struck me deeply as the rhetoric question that is produced at the beginning of it explains how I feel on most days as I give “so poor an account” of my day each night. Continually throughout my life, I have gone through the motions of a typical day with the structure presented by school and the homework that follows me after I leave. Furthermore, sports and volunteering are ingrained within the mix but still play a part in the structured daily cycle. As time has passed the cycle has stayed rather consistent,…
Supporters of this view commonly contrast Brown with R v Wilson[1997] QB 47 which involved heterosexual sadomasochistic activity, though a different act from those in Brown, which was found lawful only a few years later by the Court of Appeal. Others criticise it for being too paternalistic – if one can consent to the risk of potentially developing cancer through smoking, branding one’s body with ink to make a tattoo or the risk of injury in martial arts then why should otherwise consensual activity in someone’s bedroom be subject to the criminal law?…
The second chapter in the book, Reasons are BS, is an interesting and somewhat controversial chapter. The author of The Achievement Habit is Bernard Roth. He is a Professor of Engineering at Stanford University and director of the design school at Stanford. In the second chapter, Roth explains through personal experiences and experiences with his students, how reasons are BS. He also talks about why people think they need reasons and why they use them. Throughout this chapter Roth appeals to his audience very well. If his intended audience was college students then the language and stories he uses effectively gets his point across. Even though this chapter’s has some contradicting points, Roth does an excellent job supporting his main idea with logic, ethics and emotion.…
Rape leads into my next argument, abuse. When a mother conceives a baby she is not ready for, or simply does not want, abuse is sometimes a “way out” for her. A parent may physically, mentally and emotionally abuse their child. A child never deserves to be beaten but being abused is better than never existing at all. A young being has the chance to grow in and out of their abusive life in later years. Every abused child should suck it up and suffer the pain until reaching years of freedom.…
The movie, proof, directed by the talented John Madden had a much more effective and successful ending than the Pulitzer Prize winning proof written by David Auburn in the year 2000. Little things such as added scenes gave readers and critics a more in depth understanding of the character development of the main characters and gave us a better understanding of their personality.…
Rape - A young woman being raped and then forced to carry the baby to term could be disastrous for both mother and child. The individual did not choose to be raped. A person who is raped is a victim, and should not be forced to carry the fetus to term. Imagine if, in an unfortunate case, a young 14-year-old-girl was raped and then forced to keep the child. She would be teased and abandoned by her friends and possibly family, and may develop severe depression and anxiety problems because she was not emotionally capable to care for a child. Her then lack of education would lead to poverty and sickness. Why impose this kind of torture on a young girl? Why should the mother be stuck with extra responsibilities because she was raped? The mother shouldn’t have to go through the ordeal of carry that child to term and delivering it, then to raise it all while most likely the child is looking more and more like her attacker being constantly reminded of her painful and horrible ordeal.…
I, and many others, aren’t particularly pro abortion, we’re pro choices for women. I feel that women should have the right to do what they please with their own bodies. Although I personally feel this way, I do also feel that there are always alternatives. One of the most common reason for being pro abortion, is rape or incest. When a woman is raped and becomes pregnant, I can only imagine how difficult it would be to decide what to do with that child. This is when people most commonly say that they could understand a woman wanting to get an abortion. Although this is a very common scenario that people talk about, a survey in 2001 claimed that only one percent of abortions are caused by rape or incest. This is when I begin to see the side of being against abortion. The number one most common reason for abortion is the unpreparedness or the unreadiness of a child. This is when I feel that there are always other options. When faced with an unplanned pregnancy, women can always get some kind of financial support. Women can also put their children in foster care or put them up for adoption, but there are always negative downsides to these options. Approximately 107,918 children were waiting to be adopted on September 30th,…
If a woman was raped and then found that she was pregnanted, then it is acceptable for her to have abortion. We think that no woman will want to give birth to that baby. It is because when the mother looks at the baby that she gave birth to, it will make her remember the raping that she has experienced before And the mother will even hate this child very much .Also, she will feel fear all the time. If you force the mother to give birth to the child, then it…
Since our country was formed the use of the Death Penalty has always been a controversial subject mainly because, the government is taking an individual’s life. This has been a form of punishment for thousands of years and for hundreds of years in the United States. It has been debated for years that the death penalty is unconstitutional and many people have thought that it violates the 8th amendment because it is possibly a “cruel and unusual punishment”. It has since been left up to the states to decide if they will allow the death penalty or eradicate it. As we go deeper into the subject of capital punishment we are met with even more controversy as we approach the subject of using the death penalty against non-homicide crimes namely rape. Rape in our country is considered a very serious crime the penalties for rape are also very severe, they include prison time and indefinite registration as a sexual offender, yet some people are at times infuriated because rapists do not receive the death penalty.…
I do not think for one bit that her analogy of “unplugging the violinist” analogy works because everyone has a right to their own body and choices, unless in the case of rape. Her analogy about “unplugging the violinist” is off the chart and is not similar to pregnancy. In some cases, mothers have the choice to have intercourse with another human to make a child, while others do not have the choice because of rape. Mothers choose to have an abortion or to not have an abortion. Others might influence the mother’s decision, but the decision is ultimately the mother’s choice because she is the one that has to go through the process and procedure of getting the baby aborted. Whether or not a child gets conceived because of rape, every single person’s…
