CASE STUDY - DISCRIMINATION
INTRODUCTION
This case study introduced us to the knowledge of laws and discrimination at work place.
Vishnu has been doing a good job as a salesperson in the building industry. Improving his skills now he is facing a promotion. But the management team, after providing him a promotion, says that Vishnu needs to remove his turban, because they think that it would look more professional. That’s a typical discrimination story.
CONTENT
Vishnu is being forced to take off his turban while he is working. It works against his culture and religious background. Based on website www.wiki.answers.com, “99% of the people you will see wearing turbans will be Sikhs, a religious group that originated in India during the 15th century. Sikhs wear turbans because they believe that god gave you hair during your birth, so you should not alter god 's gifts in anyway.” As a religious man Vishnu wants to follow his believes as it was always to his life.
The anti discrimination applied to this case is as follow:
“Racial Discrimination Act 1975
Grounds of unlawful discrimination
Race, colour, descent or national or ethnic origin.
Other unlawful conduct
Racial hatred
Areas covered
Employment; provision of goods and services; right to join trade unions; access to places and facilities; land, housing and other accommodation.
Process for decision making
Complaints must be in writing. It is then assessed and if within jurisdiction is investigated. The complaint is then reviewed to see if it should be terminated or if it is suitable for conciliation. If the complaint cannot be conciliated, it will be terminated by the President of the Commission. A complainant may then take the matter to the Federal Court of Australia or the Federal Magistrates Court.”
Considering the act, Vishnu can be covered by the law, he has legal support based on it.
