I definitively agree with you, test scores would have been helpful in predicting a final decision in the firefighter case. If tests are initially required in the Fire Department as a qualification prior to being hired, those scores along with other requirements should determine the competence and intellectual abilities to perform the job. For instance, if the Fire Department would had have a well-established restriction range, those individuals with higher scores along with other elements, such as, mental stability would had facilitated the scoring and promotion within the department. Perhaps, to keep intentionally the minority group fixed, the higher commanders could had been misusing of those test and the performance evaluations.
