George Carlin's Argument For The Legalization Of Prostitution

On the subject of prostitution George Carlin said it best, “why should it be illegal to sell something that’s perfectly legal to give away?” In this article, the unnamed author presents an argument for the legalization of prostitution. Although they present very flawed justifications, I generally agree with their conclusion that prostitution should be legalized. The heart of their argument centers on the right of person to make their own decisions in regards to this issue as opposed to prohibition by government fiat. The author starts right out by claiming that it shouldn’t be the within the government’s authority to prohibit the sale of sex. Prostitution is legal in Nevada with the exception of Clark County, and Las Vegas is in Clark County. Ignoring the limited sample size and different times of the two studies that they cite, the fact that they look at Las Vegas prostitutes versus the prostitutes in the rest of the state is a false comparison. There would have to be new study that simultaneously examined both groups at the same period of time for it to be considered hard evidence. The second major error that they make is stating the government shouldn’t be able to regulate prostitution because of the constitution. They simply state that because of the constitution the government shouldn’t regulate prostitution without giving details on their reasoning. The author misses the fact that from mandating the use of seatbelts and the prohibition of recreational drugs to the banning of public nudity, the government has the authority to dictate behavior.
