Case Name: Gnazzo v. G.D. Searle & Co. 973 F 2nd 136 1992 U.S. App. Lexis 19453 United States Court of Appeals, Second Circuit

Facts: In 1974, Gnazzo had an IUD implanted in her uterus as a contraceptive device. In 1975, Gnazzo experience painful cramping which turned out to be Pelvic Inflammatory Disease (PID). Although she suffered another PID infection later, she continued to use the IUD until December 1977. In 1989, a fertility specialist told Gnazzo she was infertile because of the PID that resulted from the use of the IUD. Later that year, Gnazzo answered an attorney questionnaire stating that she first suspected the IUD had caused her infertility in 1981 after researching the product over the internet. In 1990, Gnazzo initiated a complaint against Searle; the maker of the IUD.Searle said Gnazzo’s claim was time-barred by a 3 year statute of limitations for product liability actions.

    On November 11, 1974, Gnazzo had an intrauterine device (IUD) inserted in her uterus for contraceptive purposes. The IUD was developed, marketed and sold by G.D. Searle & Co. (Searle). When Gnazzo’s deposition was taken, she stated that her doctor had informed her that “the insertion would hurt, but not for long,” and that she “would have uncomfortable and probably painful periods for the first three to four months. On October 11, 1975, Gnazzo found it necessary to return to her physician due to excessive pain and cramping. During this visit she was informed by her doctor that he thought she had Pelvic inflammatory Disease (PID). She recalled that he stated that the infection was possibly caused by venereal disease or the use of the IUD. The PID was treated with antibiotics and cleared up shortly thereafter. Less than one year later, Gnazzo was again treated for an IUD-associated infection. This infection was also treated with antibiotics.     I believe this case should be decided in favor of the petitioner. The Briseno factors, used in this case resulted in the wrongful sentencing of an intellectually disabled man. The Supreme Court should accept this case and extend its ruling in Hall to the second prong of intellectually disabled.
