In Gray by His Tutor v The State of New South Wales, Supreme Court of New South Wales, 1998, a grade 6 pupil sustained injuries during a lunchtime recess in school. The pupils were supposed to be supervised by a teacher whenever in lunchtime recess, but on this day, the supervising teacher left the classroom and asked another teacher to provide periodic supervision. It was at this time that the pupil sustained injuries. However, the school, Bellbird Public School, lacked a sheltered recreation facility. The teacher should actively and effectively manage and implement programs that ensure pupil safety, protection, and welfare. This would also entail actively supervising pupils when on playground duty or when operating equipment. Moreover, teachers, as pupils’ companions should ensure that the school’s physical and structural conditions are met in terms of the quality of the surrounding grounds, infrastructure, and buildings.
