Different laws have been created in different places trying to minimize the deaths caused by irresponsible people. In the article, “An Unsteady Finger on Gun Control Laws.” Anna Persky talks about the ability to restrict guns and how some laws do so. It is impossible to identify every incapable person, so laws restrict groups where the majority of the people would be considered incapable. Some of these groups include convicted felons, criminal drug users, Aliens, those subject to domestic restraining orders, prior convictions for domestic assault, fugitives, and those dishonorably discharged from the military(ATF 1). Gun permit laws vary throughout the U.S. The state of Kentucky’s laws to carry a concealed firearm state that you must be 21 years of age. However just four days after the Sandy Hook massacre three gun threats were made by KY high school students, as well as in March of 2013 a juvenile brought an unloaded gun on school property. Gun dealers plays an important roles in gun control because they are persons who directly conduct background checks for buyers and make sales. They are alse allowed to purchase unlimited, high-capacity guns, without going through any more background check or waiting period. However, the current system on inspecting and enforcing gun dealers is insufficient. Dealers are inspected by the government once in a decade, and gun dealers’ serious violations of firearms laws are mostly classified as misdemeanors rather than felonies (cite). The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) rarely revokes law-violating dealers (cite). In 2011, ATF took administrative action against 4,056 FFLs, but only revoked or denied the renewal of 71 licenses (cite). Consequently, once dealers have their license, they can easily become unscrupulous, start making profit through illegal sales. Indeed, 34 percent of trafficking incidences connected to gun shows involved licensed dealers that conducted straw sales, sold guns without a background check (cite). The Brady Act states that anyone convicted of a felony or offense, as well as those who have been found as not guilty due to them pleading insanity or mentally unstable, will permanently be prohibited from purchasing firearms. (Mayo Clinic). While the act has been enacted for 18 years, it has prevented 2.4 million purchases of firearms to possible felons or the mentally ill. Not only do they have to have a clean record, they also have to pass a written test to obtain a Firearm Safety Certificate to purchase the gun. Federal law requires that licensed dealers conduct a background check on the purchaser. California also demands that the dealer must be licensed by the state. Not only does the state require a background check, they also maintain a record of all firearm sales. The buyer is also limited to buying one handgun per month. This is an effective way of making sure that the buyer is not prohibited from purchasing a gun and that they do not attempt to purchase an excess amount of guns However this does not apply to private sales.
