The City of Albany decided to upgrade a fleet of repair trucks in order to respond to pothole fixing. ACME manufactured a cab and chassis of a truck that was then sold to Keefer Motors. Keefer Motors sold the truck unchanged to the City of Albany. No discussion by ACME or Keefer Motors had taken place with the City as to what the city would do with the truck. Susan’s Truck Equipment was contracted by the city to add a dump bed and hoist and the truck was modified and redelivered to the City of Albany; the truck was accepted and put into immediate use. Sarah and Emma are city employees and Sarah was injured when Emma backed up the pothole truck over her. Sarah was seriously injured and is suing ACME, Keefer Motors and Susan’s Truck Equipment, arguing that the truck was defective and unreasonably dangerous because the defendants did not advise the City of Albany to install a back-up alarm and they failed to install a back-up alarm.…

The employee who stole the shipment will cause the company to be responsible for the recovery for the injury. I believe that this is a case of the doctrine of respondeat superior. This is Latin for “let the master respond”. The employee is an agent of the company therefore the employer is responsible for their actions. Even though the employer had no idea of knowing what the agent was going to do, the company is still liable for his/her actions. As noted in the text, the following example was given, “If a truck driver, the employee of a delivery firm, negligently runs a red light and injures a pedestrian, the owner of the truck is liable for the injury” (Hallowell & Miller, 2012). In addition, the employee could be terminated because of his/her actions while being employed as an agent. The employee could be terminated because an injury or possible death occurred that was not what the agent was contracted to do. The employee could also be prosecuted because the wood pulp was stolen. Even though it was an effort to impress the company it is still punishable by law because the goods were stolen, not…

I think Stanton Wong should report the test result to the customer's source inspector, Jane Conway first and ask Jane to perform additional sample testing. I think it can help to convince Harry Jackson to stop the cable for shipping out for the customer if Jane found out there is a problem occurred on the cable. If Harry still refuse to solve the problem, then Stanton should report the case to the top management who have the power to change Harry's decision. One of the ethical reasoning is logic, it means before we can conclude or make a judgement , we have to ensure that premise, either factual or inferred, are know and clear. In this case, I think it is logical for Stanton to report the problem to authorities if the faulty items could harm innocence and also because he cares about the civilians and armed forces.…

Bryson Corporation is a cable division assembly plant. Stanton Wong is the quality supervisor of the company and his boss, Harry Jackson, is the plant manager and a vice president of operations. Stanton was responsible for preparing a detailed report of all test results when a batch of cable was ready for shipment for Bryson. On the other side, Jane Conway performed additional sample testing as the customer’s source inspector instead on Bryson’s test data. In the situation of this case, Stanton had tested a sample taken from an early lot and had good results because of the short turnaround period which revealed problems on Friday that two failed of 10 samples. He is worried about how to report the failure results to his boss as they have protocol which requires that a test failure be reported for such results.…
