Lobato by juvenile probation officer for Lincoln County, Nevada, Laura Johnson who relayed who relayed a message from Dixie Tienken a high school teacher for Lincoln County. That claimed that Ms. Lobato had confessed to her that she had attacked a man in Las Vegas that was trying to sexually assault her days prior. Detectives travelled to Panaca NV to interview Ms. Lobato regarding the death of Mr. Bailey. At which point Ms. Lobato confessed to being overtaken by stranger in Las Vegas and had no other recourse but to fight for her life. “Unknown assailant attempted to sexually assault her , that she resisted , cut him with a knife and fled the area”(Appendix). Lobato explained to the detectives that she was high on drugs and was unclear of what days she was in Las Vegas and knew that she had used her butterfly knife against the assailant, but was unaware of the extent of the injuries to him. Lobato left the assailant on the ground crying and left, “I didn’t think anybody would miss him” (Findlaw). Detectives read Ms. Lobato her Miranda Rights and placed her under arrest for the murder of Duran Bailey. The State of Nevada charged Lobato with separate counts of murder with a deadly weapon and sexual penetration of a dead
