Liebeck V. Mcdonald's Case
The Liebeck v. McDonald’s case was a product liability lawsuit filed by Stella Liebeck, a 79 year old woman who was burned by a scalding hot coffee. One Sunday afternoon in 1994, Stella Liebeck ordered a cup of coffee at a McDonald’s drive through in Albuquerque, New Mexico. As she sat alongside her grandson in a 1989 Ford Probe, Liebeck noticed that there were no cup holders on the passenger side. Acting quickly, Liebeck decided to put the coffee cup between her knees. When she removed the coffee lid, some of the coffee spilled on her lap, burning her thighs, buttocks, and groin. It was later determined that Liebeck suffered third degree burns on her skin that resulted in permanent damage. Liebeck was held in the hospital for over a week, …show more content…
For instance, Liebeck claimed that the abnormally high temperature of the coffee caused her injuries, making it defective. While I agree that the temperature of the coffee is a bit high, I don’t think it is an unreasonable temperature. Former Starbucks Barista Alecia Morgan stated in a thread on Quora that after 5 years of experience at Starbucks, she has come to learn that the ideal temperature for coffee is 180 degrees Fahrenheit. McDonald’s holds their coffee between 180 and 190 degrees, which is in line with what Morgan and others believe is the right temperature for coffee. It doesn’t make sense that Liebeck would deem this coffee defective given the fact that lots of people like the temperature of McDonald’s coffee. Morgan also stated, "Back when I first started working at Starbucks, the acceptable range for beverage temperature was around 145-165 degrees. That's not really all that hot." Coming from a coffee expert who has made lower temperature coffees, stating her honest opinion about this matter shows how unimportant the entire issue is. That doesn’t mean lower temperatures are not hazardous as well. Liquid temperatures as low as 120 degrees can cause third degree burns, and temperatures higher than that shortens the amount of time it takes for the liquid to burn the skin.     The National Coffee Association advises that coffee should be brewed at 195 to 205 degree Fahrenheit for the ideal extraction and served at 180 to 185 degrees Fahrenheit. The law firm of Gallivan, White and Boyd gave their opinion that “Just because a product can cause serious injury when handled negligently doesn’t not mean that product is unreasonably dangerous when and if used properly” (The Original Hot Coffee Product Liability Case, Gwblawfirm.com). I believe the severity of Liebeck’s injuries and her old age is what made the jury feel sympathetic and side against McDonalds restaurants. Liebeck argued that there was no warning label on the McDonalds coffee cup to inform the customer. However on McDonalds promotional poster and on their website there was sample picture that showed “Caution: Contents Hot” in an orange text on the cup. In my opinion I do not think McDonalds should have been held accountable for Liebeck acting careless with hot coffee. However, McDonalds should have covered Liebeck’s medical expenses out of good faith since they could easily afford it. McDonalds sending Liebeck for $800, which didn’t even cover half of her medical bills, displays McDonalds lack of concern and sympathy for Liebeck’s horrendous injury.     Are McDonald’s, Motor City and Starbucks at fault in situations such as these, in my opinion absolutely not? I remember I read a story about a case similar to this one, a couple, the McMahons was on a trip and stopped for coffee, the coffee spilled and the wife suffered burns. They sued the makers of the brewing machine saying it was brewing the coffee too hot. The trial was taken to court and although the court sympathized with the McMahons they believed that it cannot be that producing hot liquids makes a machine defective any more than a knife is defective because its blade is sharp. The McMahons stated that the coffee machine should have warnings on it but they both said in their depositions that they knew before purchasing the coffee that it is served hot and that there is a possibility that the coffee can cause burns. Finally the courts felt that judging in favor of the McMahons would have bad effects for other people who like their coffee hot. One of the cases referenced in McMahon v Bunn-O-Matic was Nadel v Burger King. In Nadel v Burger King, Paul Nadel and his mother, Evelyn was driving his children to school. Paul’s son, Christopher was sitting in the front between them. On the way, they ordered breakfast from the drive-through window of a Burger King restaurant. Paul's order included several breakfast sandwiches and drinks and two cups of coffee. Evelyn tasted the coffee and found it too hot to drink. The lid of the coffee “jiggled off” and burned her on her right leg after she lifted the flap. After bending the flap of the lid so that it was closed, Evelyn returned the cup, covered by the lid, to the container. She put the container of coffees on the floor next to Christopher's foot when Paul drove away from the restaurant, making a left turn onto a street. His friends and family worried about him because he had many extra-curricular activities, worked for the National Guard, and worked for McDonalds. McDonald’s informal policy did not allow high school students to work more than one midnight shift per week or split shifts. There was a special clean-up week McDonald’s held, Theurer worked five nights. One night he worked until midnight, another until 11:30pm, two nights until 9pm, and another until 11pm. On Monday, April 4th, 1988, Theurer worked from 3:30 until 7:30pm, followed by the clean up shift beginning at midnight until 5am on April 5th, and then he worked another shift from 5am until 8:21am.
