In this case the 28 male employees are wrong in doing such jokes, sexual comments, inappropriate touching, partial nudity, and offensive gestures in their department. What the 28 males did is unethical and the right conduct which the employees must show is being upset. But in a legal sense there is no sexual harassment that happened but instead there is just a wrong human conduct which leads the 4 lady employees to be irritated and filed a case. The reason behind is that Sexual harassment refers to unwelcome advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature. In short if the 4 lady employees didn’t rebuke or reject those male employees who are doing malicious actions, it is not considered sexual harassment. Sexual harassment is often imposed upon a person in an unequal power relationship through the abuse authority. Using implied reward or threat of deprivation that interferes with the work effectiveness of the ladies or the victims is also a ground in order to consider that there is a sexual harassment imposed within them. Second ground in sexual harassment is the submission to, or rejection of such conduct by an individual is made clearly and completely a term or condition for such employment or participation. In this case the ladies are in fact not given a condition for employment or participation in the department.
As an HR manager of the company I should talk to the both side of the party and discuss with them what does sexual harassment means and how does such activity become a sexual harassment in nature. I think in discussing about ethical concepts I must consider first the reaction of the both sides, asking them everything like why did the male employees do such unethical behavior in their department and how would they resolve the issues that happened and as well as the lady employees why they did not reject or rebuke the male employees. Next is I should as an HR manager respect
