Summarise the key aspects of current legislative requirements and codes of practice relevant to your subject and the type of organisation within which you would like to work.
I work as the head beauty therapist for a large spa, I am responsible for the induction and training of new therapists. As the head therapist I have to be aware of key generic legislation and stay up to date with legislation relating to my current role.
All business are covered by laws as set down by the government in Acts of Parliament, these Acts are the law of the land and breaking or ignoring them is an offence and can lead to punishment. As a senior beauty therapist you have the duty to ensure safe working practice is complied by yourself and colleges at all times. This is to guaranty the safety of all staff and any visitors to the work premises’ (Nordmann P.100) There are many acts in place to ensure a safe working environment, two very important acts are. The Health and Safety at work act 1974 is the main law maker for employers and employees, all of whom have legal duty to make sure everyone is kept healthy, safe and well at work.
This act lays down the minimum standards of health, safety, and welfare required in each area of the workplace. As the head therapist I must implement and enforce this act and ensure other employees uphold and work within the act.
The Control of substances Hazardous to health 1994 (COSHH) is the control exposure to hazards substances in the spa and assess possible risk to health. The regulation states the essential requiems for controlling exposure to hazards substances and for protecting people who may be effective by them. Under the COSHH regulations, it is my duty to carry out risk assessments of the materials being used in the
spa.
While the spa already conducts its business in a framework of relevant laws, regulations, and internal policies the beauty industry recognises that these do not govern all behaviour. It is important for all clients to understand exactly what we stand for and how they can expect us to conduct ourselves. Within the industry there is a code of practice, this is a code of behaviour and expected standards for a professional beauty therapist to follow. ‘Although not a legal requirement, this code may be used in criminal proceedings as evidence of improper practice’ (Nordmann P.120) while it is not the law to follow these rules to become a member of an awarding body like British Association of Beauty Therapy And Cosmetology (BABTAC) you must follow their guide lines. Being a member of an awarding body shows competence and high standards. As the head therapist it is my responsibility to ensure the code of conduct is followed. Two laws the code includes are not to disclose client information, and that my therapists should only carry out treatments that are within their professional qualification.
There are many more practices and laws set out to guide the beauty industry and as someone in authority it is my duty follow these laws and carry out these requirements to a high standard, It is also my responsibility to ensure therapists are aware of our codes of practice and laws to allow for a safe working environment for staff and customers.
