The Oncale v. Sundowner happened in 1998 when an employee named Joseph Oncale worked for Sundowner Offshore Services, Inc. in the Gulf of Mexico and experienced sexual harassments and humiliation from his male co-workers, which led Oncale to quit his job at Sundowner Offshore Services, Inc. during that same year. Oncale did not leave the matter at rest, so he decided to bring it to court to get to the bottom of this matter.

• Title VII of the Civil Rights protects man and women. It means that woman and men are protected against any sort of sexual harassment.
• Joseph Oncale was forcibly subjected of to sex-related (sexual harassment) by his male co-workers.
• Oncale was forcibly subjected to humiliation actions by three male crewmembers.
• Two of those crewmembers that sexually harassed him were his supervisor.
• Oncale quitted his job due to sexual harassment experience by crewmembers of the Sundowner Offshore Services, Inc.
• Oncale filed complaints against his employer and he made sure to state that it was sexual harassment directed

According to Justice Scalia J. from Case 12.3 in the book ‘’ Labor and Employment” written by David P. Twomey (2013), “ And there is another requirement that prevents Title VII from expanding into a general civility code…the statute does not reach genuine but innocuous differences in the ways men and women routinely interact with members of the same sex and of the opposite sex” (p. 442).
