• Data Protection Act 1998-
The Data Protection Act 1998 is a U.K act of parliament which defines how personal information is used by organisations, businesses or the government. It replaced and consolidated previous acts including the ‘The Data Protection Act 1984’ and ‘The Access to Personal Files Act 1987’. The act aims to safeguard the information which we hold on our learners and states that everyone who is responsible for using data must follow strict rules called ‘Data Protection Principles’ which state that:
• We must only collect information that we need for a specific purpose.
• We must store information securely.
• We must ensure the information is relevant and up to date.
• We must only hold the information for as long as it is needed.
• We must allow the subject of the information the right to see it on request.
There is also stronger protection in place for more sensitive information such as ethnic background, political opinion, religious belief and health.
As trainer assessors we are legally obliged to protect the information we hold about our learners In the Learn Direct office each learner has a file which holds all of their personal information. The files are stored in a filing cabinet which is locked and only authorised personnel are able to access it. Any information which is stored electronically is password protected to keep the security of the information to a maximum. We are also careful to ensure that any conversations about learners, their progression and any other issues are held in a suitable private environment.
By following this act we are ensuring that we do not breach any of its requirements. This in turn will ensure that we maintain the trust of our learners and employers.
