Ui vs Bonifacio
Ui vs. Bonifacio
Adm. Case No. 3319, June 8, 2000

Facts:

Complainant Lesli Ui found out that her husband Carlos Ui was carrying out an illicit relationship with respondent Atty. Iris Bonifacio with whom he begot two children. Hence, a complaint for disbarment was filed by complainant against respondent before the Commission on Bar Discipline of the Integrated Bar of the Philippines on the ground of immorality, more particularly, for carrying on an illicit relationship with the complainant’s husband. It is respondent’s contention that her relationship with Carlos Ui is not illicit because they were married abroad and that after June 1988, when respondent discovered Carlos Ui’s true civil status, she cut off all her ties with him. Respondent averred that Carlos Ui never lived with her. Issue:

Whether or not she has conducted herself in an immoral manner for which she deserves to be barred from the practice of law. Held:

The complaint for disbarment against respondent Atty. Iris L. Bonifacio, for alleged immorality, was dismissed.
All the facts taken together leads to the inescapable conclusion that respondent was imprudent in managing her personal affairs. However, the fact remains that her relationship with Carlos Ui, clothed as it was with what respondent believed was a valid marriage, cannot be considered immoral. For immorality connotes conduct that shows indifference to the moral norms of society and the opinion of good and respectable members of the community. Moreover, for such conduct to warrant disciplinary action, the same must be “grossly immoral,” that is, it must be so corrupt and false as to constitute a criminal act or so unprincipled as to be reprehensible to a high degree.

[53] Upon consideration of these factors, as in AUPE, damages instead of reinstatement should not be awarded. I am not convinced of the Employer's assertion that the Grievor's insubordination and post-discharge conduct contains the lack of trust, animosity and risk of poisoned work environment that makes the employment relationship inviable. [54] I disagree with the Employer that Grievor's post-discharge conduct clearly demonstrates her poor attitude, disregard for authority and other's safety. [55] While the Grievor's post-discharge conduct is inappropriate, there is no evidence that her co-workers will not work with her.…

Thereupon, respondent Eulalio D. Reyes acted as mayor of Carmona and the Provincial Fiscal of Cavite investigated the charges referred to in the above-quoted letter. After holding hearings in connection with said charges, the provincial fiscal submitted his report thereon on July 15, 1954. Since then the matter has been pending in the Office of the President for decision. Inasmuch as the same did not appear to be forthcoming, and the term of petitioner, who remained suspended, was about to expire, on May 13, 1955, he instituted the present action for quo warranto, upon the ground that respondent was illegally holding the Office of Mayor of Carmona, and had unlawfully refused and still refused to surrender said office to petitioner, who claimed to be entitled thereto.…

Almost half of all new marriages in the United States end in divorce. In the Philippine setting, divorce is non-existent partly because the Filipinos are naturally religious individuals and the fact that the Church, especially the Catholic Church, does not acknowledge the idea of separation and annulment. Still, the option of legal separation or annulment of troubled marriages is prevalent in our country especially among the upper and middle classes, while desertion or informal separation is common among the lower social classes (Reyes, 2004).…

The Philippines and Vatican City are the only Catholic countries and in fact the only two countries which do not permit divorce. Though The Philippines is a democratic country, and over the years, the evolution and transformation of the ways of life and the ways of thinking there have undergone dramatic changes, adopting other cultures and traditions, the nation remained religiously contained and oriented, which indicates that the majority of Filipinos still value their beliefs in the Supreme Being.A Divorce Bill, also known as House Bill 1799, is currently a controversial hot topic in the country. Though annulment, which is filed under Article 36 of Family Code in the Philippines, is duly being applied and allowed in the country, most of those who are pro-divorce would say that is not enough intervention for those couple who can't live together anymore.…

As I perused through the case of Mayelane v Ngwenyama in which the Constitutional Court had to arbitrate on the validity of a second customary marriage concluded without the consent of the prime wife on the basis of whether consent of the former wife was indeed required, I had concerns. The Court in it’s decision, developed customary law such that a subsequent marriage concluded without the first wife’s consent is invalid.…
