The primary stakeholders in this case were the husband and the wife. The lawyers were also present through much of the process, but they limit their participation if they can to allow the husband and wife come to a conclusion. The children are also involved in this case, but not a primary stakeholder due to their lack of say. They also were not present for the ultimate decision that was made. The husband in this case was wanting to get everything because in his mind, he did nothing wrong. His wife was the one that cheated, not him. However, it was obvious that they were not happy. The husband worked long hours and his wife would tend to leave after he got home from work. They did not spend much time together. The wife blamed what she did on the fact that he was not a loving husband anymore and that he only cared about work, nothing else. They were each blaming the other person and not claiming any fault, but they both did try to be good parents. They always made sure to take care of the kids and make sure they had what they needed. This process was the best alternative to use because it allowed the mediator to help the stakeholders look to the future and focus on their needs. The main objective was to also help them find a solution and to avoid blaming more fault. This process helped them to hammer it out and settle their disputes in a more delicate setting as opposed to going in front of a judge. It is not necessarily a voluntary action for the stakeholders because it was judge appointed, but it helps them to avoid litigation and come to an agreement. This also shows how mediation is more preventative in nature. The mediation process also places the settlement authority on the stakeholders because it allows them to have the authority to settle their assets, debts, and the custody of the children. This process also allows a neutral third party to be used in this situation, which is the mediator. They are used to move things along and allow the stakeholders to make decisions themselves if possible. It is hard to eliminate all bias, but they all want a fair settlement and this is what the mediator does throughout this process. They also remain confidential about the matters that are discussed.
